RECOMMENDATION:
It is recommended that the Board of Supervisors approve and authorize the Contracts/Purchasing Officer to sign Amendment No. 1 to professional services agreement with Kennedy/Jenks Consultants (Lake San Antonio Resort/Marina Site), extending the agreement term by one year to January 31, 2016, for required work needed to support Lake San Antonio environmental remediation and properly address the State Regional Water Board's current site clean-up concerns and recommendations, in an amount not to exceed $212,000 for a total compensation amount not to exceed $231,700.
 
SUMMARY/DISCUSSION:
The CAO-Budget and Analysis Division requested County Counsel-Risk Management Division to assume responsibility for the payment and tracking of the fuel spill costs on behalf of the County.  County Counsel-Risk Management Division requested and received support from the Board of Supervisors to authorize the transfer of General Fund Contingency funds last fiscal year for $1,018,685 to the newly created Lakes Fuel Spill Budget Unit 8429 for remediation costs related to the San Antonio and Nacimiento Lakes Fuel Spill.  The transfer was approved by the Board of Supervisors on June 11, 2013.  As indicated within our board report, (#13-0644, on June 25, 2013) County Counsel-Risk Management Division is utilizing the services of a licensed engineering and geological firm (Kennedy/Jenks) for the required work.  Working toward full remediation, County Counsel-Risk Management Division now requests the Board of Supervisors approve and authorize the Contracts/Purchasing Officer to sign Amendment No. 1 to the March 5, 2014, professional services agreement with Kennedy/Jenks Consultants (Lake San Antonio Resort/Marina Site), extending the duration of the agreement term by one year, from January 31, 2015 to January 31, 2016, for required work needed to support Lake San Antonio environmental remediation and properly address the State Regional Board's current site clean-up concerns and recommendations, in an amount not to exceed $212,000 for a total compensation amount not to exceed $231,700.
 
OTHER AGENCY INVOLVEMENT:
The attached Professional Services Agreement (PSA) Amendment No. 1 has been approved by County Counsel as to legal form; the Auditor-Controller as to fiscal terms; and County Counsel-Risk Management Division for insurance and indemnity provisions.  Additionally, County Counsel-Risk Management Division met and reviewed the subject Professional Services Agreement (PSA) Amendment No.1 with CAO - Budget & Analysis, Auditor-Controller, and County Counsel and they have executed same.
 
FINANCING:
This amendment will be funded from the Lakes Fuel Spill Budget Unit 8429 and is included in the FY 2014-15 budget and the FY 2015-16 budget, subject to adoption.
