b. Approve non-standard terms to the Mental Health Services template agreement, on which this agreement is based, omitting Sections XIII and XIV for Budget and Expenditure and Cost Reporting, the provisions of which are not applicable to this vendor, as recommended by the Director of Health; and;
c. Approve and authorize the Director of Health or Assistant Director of Health to approve up to three (3) future amendments that do not exceed ten percent (10%) ($209,537) of the original Agreement amount and do not significantly alter the scope of services.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Director of Health or Assistant Director of Health to execute a one-year Mental Health Services Agreement with California Psychiatric Transitions for the provision of mental health services for adults with severe psychiatric disabilities, for a maximum County obligation of $2,095,375 for the term of July 1, 2019 through June 30, 2020; and
b. Approve non-standard terms to the Mental Health Services template agreement, on which this agreement is based, omitting Sections XIII and XIV for Budget and Expenditure and Cost Reporting, the provisions of which are not applicable to this vendor, as recommended by the Director of Health; and; and

SUMMARY/DISCUSSION:
California Psychiatric Transitions (CPT), located in Delhi, California, is one of a very limited number of Mental Health Rehabilitation Centers (MHRC’s) that specialize in working with people with severe mental disabilities. This facility provides client specific programs including behavioral adjustment, self-help skill development, pre-vocational preparation, and addressing special needs in interpersonal relationships. CPT provides specialized services that meet Behavioral Health clients’ needs for immediate MHRC placement at a lower level of care upon hospital discharge, as well as court-ordered diversion hold levels for individuals found both competent and incompetent to stand trial. CPT also provides intensive therapy for patients struggling with disruptive behaviors, including assaultive and self-harming behaviors, with a higher resident to staff ratio, and 24-hour nursing. This facility is the last resort before a client is placed in a State Hospital.
The County currently maintains Agreement A-13919 with California Psychiatric Transitions which will expire on June 30, 2019. This new Agreement continues the same contract provisions and rates as the expiring FY 2018-19 Agreement but eliminates one unused main floor bed for a cost savings to the County of $146,000 for FY 2019-20 (-6.5%). The approval of this Agreement will provide the necessary resources and maintains the appropriate options for clients to be placed in a facility that best suits their needs, and to live in the least restrictive community setting as possible considering their disabilities. This Agreement meets the requirements of the State Welfare and Institutions Code 5600 (Bronzan-McCorquodale Act), the California Code of Regulations Titles 9 and 22, and sustains the continuity of care services to seriously mentally ill clients of Monterey County.
This Agreement contains the County’s standard 30-day “no cause” provision (Section IV, B) and an additional defunding provision (Section IV, D), which provides the County the ability to amend or terminate the Agreement in the event of a reduction and/or termination of funding.
This work supports the following Monterey County Health Department 2018-2022 strategic plan initiative: 3. Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services. It also supports one of the ten essential public health services, specifically: 7. Link people to needed personal health services and assure the provisions of health care when otherwise unavailable
OTHER AGENCY INVOLVEMENT:
County Counsel-Risk Management and Auditor-Controller have reviewed and approved this Agreement as to legal form and fiscal provisions respectively.
FINANCING:
This Agreement is 100% funded by 1991 Mental Health Realignment revenues. The funds for this Agreement ($2,095,375) are included in the Health Department’s Behavioral Health (HEA012, Unit 8410) Fiscal Year 2019-20 Requested Budget.
