a. Approve and authorize the Director of Health Services or designee to execute a Mental Health Services Agreement for a retroactive term beginning July 1, 2024 through June 30, 2026 with Star View Behavioral Health, Inc., for the provision of Community Treatment Facility and Psychiatric Health Facility services in the amount of $224,897 for Fiscal Year (FY) 2024-2025 and $246,112 for Fiscal Year (FY) 2025-2026, for a total Agreement amount not to exceed $471,009 for the term of July 1, 2024 through June 30, 2026; and
b. Approve and authorize the Director of Health Services or designee to execute up to three (3) future amendments that do not exceed 10% ($47,100) of the original Agreement amount, do not significantly change the scope of services and do not increase the total not to exceed amount over $518,110.

RECOMMENDATION:
It is recommended that the County of Monterey Board of Supervisors:
a. Approve and authorize the Director of Health Services or designee to execute a Mental Health Services Agreement for a retroactive term beginning July 1, 2024 through June 30, 2026 with Star View Behavioral Health, Inc., for the provision of Community Treatment Facility and Psychiatric Health Facility services in the amount of $224,897 for Fiscal Year (FY) 2024-2025 and $246,112 for Fiscal Year (FY) 2025-2026, for a total Agreement amount not to exceed $471,009 for the term of July 1, 2024 through June 30, 2026; and

SUMMARY/DISCUSSION:
Star View Behavioral Health, Inc. is a high-level mental health treatment facility serving emotionally disturbed youth between 11 and 17 years of age. Services are provided through a 16-bed Psychiatric Health Facility (PHF), and through a 44-bed locked Community Treatment Facility (CTF) which provides sub-acute care, supervision and intensive treatment in a structured and secure residential environment. The facility is fully secured and designed to assist youth who have extensive histories of treatment failures from other placements. The facility provides medically based, psychosocial-rehabilitation treatment program for youth requiring medium term intensive treatment with an on-grounds school, activity program, and treatment staff. This Agreement is not based on cost reimbursement therefore Exhibit H (Budget and Expenditure Report) has been redacted. This agreement is retroactive to July 1, 2024, due to ongoing negotiations for services provided by Star View Behavioral Health, Inc.
This Agreement contains the County’s standard 30-day “no cause” provision (Section V, B) and an additional defunding provision (Section V, D), which provides the County the ability to amend or terminate the Agreement in the event of a reduction and/or termination of funding.
This work supports one of the County of Monterey Health Department 2025-2028 Strategic Plan Goal(s): 2) Provide Exceptional Person-Centered Care through Accessible, Community-Focused Health Services. It also supports one of the ten essential public health services, specifically: (7) Link people to needed personal health services and assure the provision of health care when otherwise unavailable.
OTHER AGENCY INVOLVEMENT:
The Office of County Counsel and Auditor-Controller have reviewed and approved this Agreement as to legal form and fiscal provisions, respectively.
FINANCING:
This Agreement is funded by Federal Financial Participation (FFP 50%) and Early & Periodic Screening, Diagnosis & Treatment (EPSDT/2011 Realignment 50%). The funds for this Agreement are included in the Health Department’s Behavioral Health (HEA012, Unit 8410) Fiscal Year (FY) 2024-25 Adopted Budget. The funds for FY 2025-26 are included in the Department’s (HEA012, Unit 8410) FY 2025-26 Requested Budget.
