a. Approve and authorize the Assistant County Administrative Officer to sign a Memorandum of Understanding in the amount of $1,000,000 with the Monterey County Office of Education for the retroactive term September 1, 2020 through December 30, 2020, as reimbursement for purchases of technology for Monterey County schools;
b. Authorize the Assistant County Administrative Officer to sign up to three (3) future amendments to this Agreement where each amendment does not exceed ten percent ($100,000) of the original contract amount and does not significantly change the scope of work; and
c. Approve a resolution authorizing the Auditor-Controller to amend the FY 2020-21 County Administrative Office Non-Departmental, Contributions to Other Agencies operating adopted budget 001-1050-CAO007-8029 to increase appropriations by $1,000,000, financed by an increase in Non-Program Revenue 001-1050-CAO019-8041 (4/5th vote required).

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Assistant County Administrative Officer to sign a Memorandum of Understanding in the amount of $1,000,000 with the Monterey County Office of Education for the retroactive term September 1, 2020 through December 30, 2020, as reimbursement for purchases of technology for Monterey County schools;
b. Authorize the Assistant County Administrative Officer to sign up to three (3) future amendments to this Agreement where each amendment does not exceed ten percent ($100,000) of the original contract amount and does not significantly change the scope of work; and
c. SUMMARY/DISCUSSION:
The Monterey County Office of Education (MCOE) and Monterey County (County) collaborate in many programs throughout the community. The County received Coronavirus Aid, Relief, and Economic Security Act (CARES Act) funds as part of the $2.2 trillion economic stimulus passed by the U.S. Congress. These funds were allocated to the State of California which allocated $44.9 million to the COUNTY to help the COUNTY with its response to the COVID19 Pandemic.
The County Board of Supervisors (Board) approved (August 18, 2020) using $1,000,000 of the CARES Act funding received by the County to fund digital divide purchases to be made by MCOE for the purpose of helping students in Monterey County schools who as a result of the pandemic do not have access to technology enabling them to access educational resources remotely. Execution of this agreement enables the reimbursement of funds to MCOE as approved by the Board. The MOU has a retroactive date to allow for immediate purchases of technology for County’s students and allows for an advance payment to MCOE of $1,000,000 for cash flow purposes. A reconciliation of actual expenditures will occur to ensure all allocated funds were spent for the approved purpose.
OTHER AGENCY INVOLVEMENT:
The MOU has been approved by the Office of County Counsel-Risk Management as to legal form and risk provisions, and by the Auditor-Controller as to fiscal terms.
FINANCING:
This agreement is fully funded by CARES. Approval of this item has no financial impact to the General Fund.
