RECOMMENDATION:
It is recommended that the Board of Supervisors:
a.  Approve and authorize the Director of Health to sign a three-year term Mental Health Services Agreement (July 1, 2012 to June 30, 2015) with ASPIRAnet , for the provision of mental health services in the amount of $289,744 for Fiscal Year (FY) 2012-13, $289,744 for FY 2013-14, and $289,744 for FY 2014-15, for a total Agreement in the amount of $869,232; and
b.  Authorize the Director of Health to approve up to three future amendments to this Agreement where the amendments do not exceed ten percent (10%) of the original amount and do not significantly change the scope of work or result in an increase in the County General Fund Contribution.
 
SUMMARY/DISCUSSION:
This new Mental Health Services Agreement with ASPIRAnet replaces Agreement A-11585 which expires on June 30, 2012.  ASPIRAnet will continue to provide Therapeutic Behavioral Services (TBS) to Monterey County children who are eligible for Medi-Cal and meet criteria for medical necessity. These services are available to children with difficult behaviors who require one-to-one assistance and who may be at risk of psychiatric hospitalization.  TBS is an intensive one-to-one, face-to-face, short term outpatient treatment intervention for beneficiaries under age 21 with serious emotional disturbances (SED) who are experiencing a stressful transition or life crisis and need additional short-term specific support services.
 
The requirement of TBS service level is due to a result of a lawsuit against the State Department of Mental Health (Emily Q. v. Bonta). This class action lawsuit was filed in 1998, whereby, the federal court ordered a permanent injunction and final judgment in 2001 to increase the penetration rate of TBS services to youth.  The injunction recognized TBS as a Medi-Cal reimbursable Early and Periodic Screening and Diagnostic Treatment (EPSDT) supplemental service and ordered the State Department of Mental Health to implement procedures for requesting and accessing TBS as a Medi-Cal EPSDT service, and to inform Class members about these available procedures.
 
 ASPIRAnet will continue to provide Home Alternatives to Residential Treatment (HART) services. These services are student focused behavioral and developmental support services to referred students who have Individual Education Plan (IEP). Each student will have an implementation plan that will include provision of multi-faceted coordinated, highly individualized services that address their needs to achieve positive outcomes in their lives.
 
OTHER AGENCY INVOLVEMENT:
County Counsel, Auditor-Controller, and Risk Management have reviewed and approved this Agreement as to legal form, fiscal provisions, and insurance requirements.  This Agreement is on file with Clerk of the Board.
 
FINANCING:
Costs associated with provision of TBS in this Agreement are funded by Medi-Cal (95%) and Realignment revenues for Medi-Cal eligible children (5%).  Cost associated with the HART program are 100% reimbursable by the Monterey County Special Education Local Area Plan (SELPA) with state appropriations and IDEA federal funds.  This Agreement is for $289,744 for Fiscal Year (FY) 2012-13, $289,744 for FY 2013-14, and $289,744 for FY 2014-15, for a total Agreement in the amount of $869,232.  The funds for FY 2012-13 are included in the Health Department's Behavioral Health (HEA012, Unit 8410) Fiscal Year 2012-13 Requested Budget. Approval of this action has no impact on the County General Fund.
