a. Approve and authorize the Director of Public Works, Facilities and Parks (PWFP) to execute the Right of Way Contract (“Agreement”) between the County of Monterey (“County”) and the State of California, Department of Transportation (“State”, or Caltrans) for real property located off Highway 1 in the unincorporated area of Big Sur, California, for State highway purposes; and
b. Authorize the Director of Public Works, Facilities and Parks (PWFP) to execute any related documents needed to complete the transaction, including, but not limited to, any future amendments to the Amendment subject to the review and approval of the Office of the County Counsel.

It is recommended that the Board of Supervisors:
a. Approve and authorize the Director of Public Works, Facilities and Parks (PWFP) to execute the Right of Way Contract (“Agreement”) between the County of Monterey (“County”) and the State of California, Department of Transportation (“State”, or Caltrans) for real property located off Highway 1 in the unincorporated area of Big Sur, California, for State highway purposes; and
b. Authorize the Director of Public Works, Facilities and Parks (PWFP) to execute any related documents needed to complete the transaction, including, but not limited to, any future amendments to the Amendment subject to the review and approval of the Office of the County Counsel.
SUMMARY/DISCUSSION:
The State of California, Department of Transportation (“State”, or Caltrans), provides safe and reliable transportation networks that serve all people and the environment throughout California. In February 2021, the County granted the State a 7,978 square foot temporary construction easement to allow the State to access the impacted area, conduct drainage installation, and to stabilize the landslide located on a portion of real property commonly referred to as Assessor’s Parcel Number (APN) 421-021-002 (the “Parcel”). The State has completed the emergency repair work which included the installation of a drainage system on the County owned Parcel.
The State would like to acquire a 14,552 square foot permanent drainage easement so the State can access and maintain its drainage area on the Parcel in perpetuity. The established amount for just compensation from the State to the County for the temporary construction easement and permanent drainage easement (the “Easements”) is Six Thousand and Nine Hundred Dollars ($6,900).
Approval and execution of the proposed Agreement will grant the State the right of access and maintenance responsibility for its drainage area on the Parcel in perpetuity.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel has reviewed and approved the proposed Agreement as to form.
FINANCING:
The Board Report and the proposed Agreement were developed by the Public Works, Facilities and Parks (PWFP) Department staff and funded as part of the fiscal year (FY) 2024-25 PWFP Adopted Budget, General Fund 001, Facilities Appropriation Unit PFP054. The total consideration of $6,900 for the Easements will be deposited into General Fund, Facilities.
