and release all claims against and waive any outstanding ownership

rights applicable to that vehicle; and

b. Authorize the Contracts/Purchasing Officer to release the van to

Kinship Center in furtherance of its ongoing programs pursuant to

the County's standard vehicle release procedure.

Upon motion of Supervisor Potter, seconded by Supervisor Armenta, and carried by those

members present, effective July 27, 2010, the Board hereby:

a. Declared the 2007 Chevrolet Express 13 passenger van, vehicle identification number

1 GAHG39U671189899, as surplus property and release all claims against and waive any

outstanding ownership rights applicable to that vehicle; and

b. Authorized the Contracts/Purchasing Officer to release the van to Kinship Center in

furtherance of its ongoing programs pursuant to the County's standard vehicle release

procedure.

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Declare the 2007 Chevrolet Express 13 passenger van, vehicle identification nun er

1GAHG39U671189899, as surplus property and release all claims against and waive any outstanding

ownership rights applicable to that vehicle; and

b. Authorize the Contracts/Purchasing Officer to release the van to Kinship Center in furtherance of its ongoing

programs pursuant to the County's standard vehicle release procedure.

SUMMARY/DISCUSSION:

The Kinship Center's Family Ties program has been providing an array of supportive services for relative

and near-kin caregivers since 2002. Services are targeted for caregivers of children who are at risk of

entering the Child Welfare System, or who have already been determined to be dependents of the Court. In

2007, the Department of Social and Employment Services DSES) worked with the California Department

of Social Services CDSS) to arrange for State Kinship Supportive Services Program funds to add a Family

Ties office in South County and authorized Kinship Center to purchase a 13-passenger Chevrolet Express

van Vin 1 GAHG39U671189899)as part of that program with State Contract funds. Kinship Center

obtained the vehicle and has used it for program services since acquisition. The expansions of services and

use of the vehicle, as well as the use of other Kinship Center vehicles, were put into place to help families

overcome geographic barriers to participation.

At this time DSES recommends the County release any and all claims against the title of the van, that, to the

extent necessary, the van be declared surplus, and full ownership rights be transferred to the Kinship Center

in support of continued services to south county caregivers and youth. DSES staff has been in ongoing

communication with CDSS regarding the purchase and use of the van by Kinship Center and there are no

restrictive conditions from the State in the KSSP allocation regarding transferring the van to the Kinship

Center. CDSS is in agreement with the recommendation that Kinship Center acquire full title to the van in

furtherance of Kinship Center's provision of services to relative and near-kin caregivers within Monterey

County.

Government Code 25372 expressly authorizes donation of surplus property of a county to a tax exempt

organization. The specific wording is as follows:

25372. a) Except as restricted by any conditions by which the county acquired the property, the board of

supervisors may donate or lease any real or personal property that the board declares to be surplus

to any public agency or organization exempt from taxation listed in subdivision b). The board

may impose on the donation or lease any terms and conditions that it determines to be

appropriate.

b) This section applies to all of the following:

1)An organization exempt from taxation pursuant to 26 U.S.C. Sec. 501(c)(3) that is

organized for the care, teaching, or training of children or developmentally disabled

children.

As part of the release of claims against the vehicle, Kinship Center will execute the County's standard

release form absolving the County from any and all liability arising from the use/ownership of the vehicle.

No other recommended conditions or restrictions are recommended or requested at this time.

OTHER AGENCY INVOLVEMENT:

The California Department of Social Services, which granted the funds used for the original purchase of the

van concurs with the recommended actions. In addition the County Counsel, Purchasing and the County

Administrator's Office have reviewed and approved this Board Report.

FINANCING:

The van was purchase with state funds through CDSS. There is no impact to the County General Fund.
