a. Approve Amendment No. 2 to Professional Services Agreement, No. A-12323, with Fonseca/McElroy Grinding Company, Inc., to continue to provide services associated with on-call rental of fully operated, fueled and maintained asphalt grinding and paver machines at various locations in the County as directed by the County of Monterey, Resource Management Agency - Public Works, in the amount of $100,000 for a total amount not to exceed $300,000, and extend the term to June 30, 2014; and
b. Authorize the Contracts/Purchasing Officer to execute Amendment No. 2 to Professional Services Agreement, No. A-12323, and future amendments that do not significantly alter the scope of work or change the approved Agreement amount.

RECOMMENDATIONS
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 2 to Professional Services Agreement, No. A-12323, with Fonseca/McElroy Grinding Company, Inc., to continue to provide services associated with on-call rental of fully operated, fueled and maintained asphalt grinding and paver machines at various locations in the County as directed by the County of Monterey, Resource Management Agency - Public Works, in the amount of $100,000 for a total amount not to exceed $300,000, and extend the term to June 30, 2014; and
b. Authorize the Contracts/Purchasing Officer to execute Amendment No. 2 to Professional Services Agreement, No. A-12323, and future amendments that do not significantly alter the scope of work or change the approved Agreement amount.
SUMMARY/DISCUSSION:
The County's ten-year old, asphalt grinding machine broke down in May 2012, with parts either not available without a significant delay, or prohibitively expensive. As a result, the County entered into a Professional Services Agreement (PSA) with Fonseca/McElroy Grinding Company, Inc. (FMG).
On May 11, 2012, the Contracts/Purchasing Officer executed a PSA, MYA 3000#385, with FMG, in the amount of $70,000 to provide on-call rental of a fully operated, fueled and maintained asphalt grinding machine at various locations in the County as directed by the County of Monterey, Resource Management Agency - Public Works (RMA-PW) for a term to April 30, 2013 (Exhibit 1 attached).
Since then, the County's paving machine also broke down. On September 11, 2012, the Board of Supervisors approved Amendment No. 1 to PSA, No. A-12323, with FMG in the amount of $130,000 to provide and include on-call rental of a fully operated, fueled and maintained paving machine at various locations in the County, and extended the term to June 30, 2013 (Exhibit 2 attached).
The County has identified a continued need for FMG to provide on-call rental of fully operated, fueled and maintained asphalt grinding and paving machines at various locations in the County. Amendment No. 2 will increase the PSA with FMG by $100,000, for a total amount not to exceed $300,000, and extend the term to June 30, 2014.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel, and Auditor-Controller, have reviewed and approved Amendment No. 2 as to form and legality, and fiscal provisions, respectively.
FINANCING:
The costs associated with Amendment No. 2 will be funded by the Road Fund (Fund 002, Unit 8195). Sufficient appropriations will be available in the FY 2013-14 Budget to fund Amendment No. 2.
