a.  Declare two (2) County owned relocatable classroom buildings located at 1420 Natividad Road, Salinas, California  (Juvenile Hall Facility) as surplus personal property;

b.  Approve and authorize the Contracts/Purchasing Officer to execute a Transfer Agreement with Rancho Cielo, Inc., a California nonprofit public benefit corporation for the conveyance of two (2) County owned relocatable classroom buildings located at 1420 Natividad Road, Salinas, California pursuant to Government Code Section 25372; and

c.  Authorize the Contracts/Purchasing Officer to execute any and all documents needed to complete the transaction, including but not limited to the Transfer Agreement, Release of Title, notices or related documents.

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.  Declare two (2) County owned relocatable classroom buildings  located at 1420 Natividad Road, Salinas, California  (Juvenile Hall Facility) as surplus personal property;

 

b.  Approve and authorize the Contracts/Purchasing Officer to execute a Transfer Agreement with Rancho Cielo, Inc., a California nonprofit public benefit corporation for the conveyance of two (2) County owned relocatable classroom buildings  located at 1420 Natividad Road, Salinas, California pursuant to Government Code Section 25372; and

 

c.  Authorize the Contracts/Purchasing Officer to execute any and all documents needed to complete the transaction, including but not limited to the Transfer Agreement, Release of Title, notices or related documents. 

 

SUMMARY/ DISCUSSION:

 

The two (2) relocatable classroom buildings  located at 1420 Natividad Road (within the Juvenile Hall Facility) have been used by the Probation Department, in partnership with Monterey County Office of Education (MCOE), for Alternative Education programs for Juvenile Hall admitted youth since September of 2006

With Board approval of the Transfer Agreement the two (2) County owned relocatable classroom buildings will be conveyed “as is” to Rancho Cielo, Inc. under Government Code Section 25372 (b) (5), which states that the Board of Supervisors may donate any personal property that the board declares to be surplus to an organization exempt from taxation, pursuant to 26 U.S.C. Sec. 501 (c) (3) that is organized to provide health and human services.

 

Rancho Cielo has a long term lease with the County on 100 acres of County owned property located at 710 Old Stage Road in Salinas, which expires February 28, 2055.  Rancho Cielo would like to increase their physical classroom footprint at this site to further its commitment to Monterey County youth.  One (1) relocatable classroom building would accommodate an additional 20 at-risk youth for the Silver Star Youth Program, which presently has a waiting list. The other relocatable classroom building would be used for the culinary students who presently are using the dining room as their classroom.

 

Rancho Cielo will be removing the relocatable classroom buildings by April 30, 2016, to make way for the New Juvenile Hall grant funded project, which is anticipated to commence in June 2016. The two (2) relocatable classrooms were previously considered to be part of the demolition phase of the project.

OTHER AGENCY INVOLVEMENT:

 

The Office of the County Counsel has reviewed and approved the proposed Transfer Agreement as to form and legality.  Risk Management has reviewed the proposed Transfer Agreement as to indemnity provisions. The Probation Department supports the proposed Transfer Agreement. 

 

FINANCING:

 

There is no financial impact to the General Fund.  All costs associated with the removal of the two (2) relocatable classroom buildings will be at the expense of Rancho Cielo, Inc.
