Title: a. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and authorize the Director of Public Works, Facilities and Parks or designee to execute a non-Standard Agreement between Hach Company and the County of Monterey for services to monitor water treatment plant equipment at Lake Nacimiento and Lake San Antonio, South Shore with a term beginning May 1, 2026 through April 30, 2029, for an amount not to exceed of $200,000;

b. Approve Contract Addendum to Standard Agreement for non-standard clauses including Services, Indemnification, Limitation of Liability, Warranty, Intellectual Property; Information Technology; Privacy; Performance Guarantees; Acceptance and Set off; Funds Transfers; and Miscellaneous; and

SUMMARY:

The Department of Public Works, Facilities and Parks requests approval to contract with Hach Company (Hach) for the monitoring of equipment at water treatment plants at Lakes Nacimiento and San Antonio.  Services include field service and preventative maintenance services.

 

DISCUSSION:

Hach Company is a global leader in developing innovative solutions that help customers analyze water more efficiently and effectively.  Hach products are used worldwide in laboratory, field, and in-process applications across municipal and industrial facilities.  Hach supports customers in making informed decisions to ensure regulatory compliance, improve energy efficiency, reduce production waste, enhance product quality, and optimize utilities management.

 

Hach will provide monitoring services for County equipment at water treatment plants located at Lakes Nacimiento and San Antonio South Shore.  Services include inspection, calibration, and maintenance of water quality monitoring instruments.  Regular calibration and maintenance are essential to ensure the equipment remains fully operational and compliant with drinking water regulatory requirements.  All calibration services will be performed by qualified professionals. Upon completion of field performance services, Hach will issue a Certificate of Instrument Performance to verify that the equipment meets required operational standards.

 

Hach submitted a Contract Addendum to the County’s Standard Agreement for non-standard clauses for Services, Indemnification, Limitation of Liability, Warranty, Intellectual Property; Information Technology; Privacy; Performance Guarantees; Acceptance and Set off; Funds Transfers; and Miscellaneous.

 

Staff requests the Board of Supervisors approve and authorize the Director of Public Works, Facilities and Parks or designee to execute the proposed Non-Standard Agreement and Addendum (Attachment A) with Hach for a term of May 1, 2026 to April 30, 2029, and to execute up to two future amendments for an aggregate not to exceed total of $240,000.

 

OTHER AGENCY INVOLVEMENT:

The Office of County Counsel, Risk Manager and Auditor-Controller’s Office reviewed and approved the proposed Non-Standard Agreement and Addendum as to form and fiscal provisions, respectively.

 

FINANCING:

There is sufficient funding in the Fiscal Year 2025-2026 Adopted Budget, for General Fund 001, Park Operations Appropriation Unit PFP058.  Future costs will be included in the respective fiscal year recommended budgets.
