a. Approve Amendment No. 3 to Professional Services Agreement No. A-12323 with Fonseca/McElroy Grinding Company, Inc. to continue to provide services associated with on-call rental of fully operated, fueled and maintained asphalt grinding and paver machines at various locations in the County as directed by the County of Monterey, Resource Management Agency - Public Works, in the amount of $150,000 for a total amount not to exceed $450,000, and extend the term to June 30, 2015; and
b. Authorize the Contracts/Purchasing Officer to execute Amendment No. 3 to Professional Services Agreement No. A-12323 and up to three (3) future amendments to said Agreement where the amendments do not significantly alter the scope of work or change the approved Agreement amounts.

RECOMMENDATIONS:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 3 to Professional Services Agreement No. A-12323 with Fonseca/McElroy Grinding Company, Inc. to continue to provide services associated with on-call rental of fully operated, fueled and maintained asphalt grinding and paver machines at various locations in the County as directed by the County of Monterey, Resource Management Agency - Public Works, in the amount of $150,000 for a total amount not to exceed $450,000, and extend the term to June 30, 2015; and

SUMMARY/DISCUSSION:
The County has identified a continued need for Fonseca/McElroy Grinding Company, Inc. (FMG) to provide on-call rental of fully operated, fueled and maintained asphalt grinding and paver machines at various locations in the County. Amendment No. 3 will increase Professional Services Agreement (PSA) A-12323 between Monterey County and Fonseca/McElroy Grinding Company, Inc., by $150,000, for a total amount not to exceed $450,000, and extend the term to June 30, 2015. See Attachment A - Summary of Professional Services Agreement.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel, and Auditor-Controller, have reviewed and approved Amendment No. 3 as to form and legality, and fiscal provisions, respectively.
FINANCING:
The costs associated with Amendment No. 3 to this PSA will be funded by the Road Fund (Fund 002, Unit 8195). The recommended budget for Fiscal Year (FY) 2014-15 budget includes sufficient appropriations to fund Amendment No. 3 pending the adoption of the budget on June 24, 2014.
