b. Approve and authorize the Director of Health Services or designee to execute up to three future amendments that do not significantly change the scope of services.

RECOMMENDATION:
It is recommended that the County of Monterey Board of Supervisors:
a. Approve and authorize the Director of Health Services or designee to execute Amendment No. 1 to AGREEMENT No. A-15428 the Designation Agreement for Trauma Center Services between the County of Monterey Emergency Medical Services (EMS) Agency and Natividad Medical to extend the term of the agreement for two years, for an aggregate term of July 1, 2021 to June 30, 2028 and updates citations to renumbered State of California regulations; and
b. Approve and authorize the Director of Health Services or designee to execute up to three future amendments that do not significantly change the scope of services.
SUMMARY:
The Director of Health Services seeks approval to execute Amendment No. 1 to the Agreement with Natividad for trauma center services and the designation of Natividad as a trauma center in the County of Monterey. This amendment extends the term of the agreement to June 30, 2028, and updates citations to regulations that were renumbered by the State of California EMS Authority since the execution of the original agreement.
DISCUSSION:
The Emergency Medical Services (EMS) Agency is designated under California law by the County of Monterey as the local Emergency Medical Services Agency (LEMSA) responsible for planning, implementing, and evaluating the local EMS system throughout the County of Monterey. California Code of Regulations, Title 22, Division 9, Chapter 6.1 states that the LEMSA shall define the trauma care system in a trauma care system plan and designate trauma center(s) in accordance with that plan. The County of Monterey EMS Agency’s state-approved trauma care system plan designates Natividad as the trauma center for the county.
The existing agreement provides that Natividad is designated as the trauma center in Monterey County and will provide trauma center services in compliance with all applicable federal, state, and county rules and regulations, ordinances, EMS Agency policies and procedures, and the requirements of the American College of Surgeons Committee on Trauma for a Level II Trauma Center.
Amendment No. 1 extends the term of the agreement for two years, for an aggregate term of July 1, 2021 to June 30, 2028 and updates citations to regulations that were renumbered by the State of California since the execution of the original agreement.
All other terms and conditions of the Agreement dated July 20, 2021, remain unchanged and in full effect.
This amendment supports the EMS Agency’s responsibility under California law to oversee, regulate, and ensure compliance within the local EMS system.
This work supports the County of Monterey Health Department 2025-2028 Strategic Plan Goal(s): Provide Exceptional Person-Centered Care through Accessible, Community-Focused Health Services. It also supports the following of the ten essential public health services, specifically: Link people to needed personal health services and assure the provision of health care when otherwise unavailable.

The Office of the County Counsel has reviewed and approved this agreement as to legal form.
