Designate and authorize the Public Defender and Chief Assistant Public Defender, on behalf of the County of Monterey Board of Supervisors, to execute Grant Agreement No. BSCC 1326-24, including any amendments thereto, with the BSCC for a total grant amount of $8,000,000 with a performance period of October 3, 2024, through June 30, 2028.
c. Direct that grant funds received hereunder shall not be used to supplant expenditures controlled by the County of Monterey Board of Supervisors.
d. Direct that the Office of the Public Defender agree to abide by the terms and conditions of the Grant Agreement as set forth by the BSCC.

RECOMMENDATION:
It is recommended that the Board of Supervisors:

SUMMARY:
On November 12, 2024, per Board Order No. A-17152, the County of Monterey Board of Supervisors authorized the Office of the Public Defender to accept an $8,000,000 Proposition 47 Cohort IV Grant award from the BSCC and authorized the Public Defender or Chief Assistant Public Defender to execute the associated Grant Agreement No. BSCC 1326-24 with the BSCC. It was subsequently determined that certain information required by the BSCC was omitted from Board Order No. A-17152, thereby necessitating a new resolution be adopted. This new resolution controls to the extent that there are any inconsistencies between this resolution and Board Order No. A-17152.
The BSCC requires issuance of a Governing Board Resolution that expressly outlines the title of the designated official, on behalf of the County of Monterey Board of Supervisors, authorized to execute the Grant Agreement, and any amendments thereto, with the BSCC. In addition, the BSCC requires specific language referencing supplanting and affirming agreement to abide by the terms and conditions of the Grant Agreement. While some of this language was included in Board Order No. A-17152, the BSCC has required issuance of a new resolution containing their specific, required language. This resolution serves to remedy the missing information from Board Order No. A-17152 and to meet the Governing Board Resolution requirements set forth by the BSCC.
DISCUSSION:
The Office of the Public Defender submitted a proposal entitled Effecting Change in Circumstances (ECC) to the BSCC for Proposition 47 Cohort IV funding and was subsequently awarded an $8,000,000 grant with a period of performance of October 3, 2024, through June 30, 2028.
ECC will provide services to approximately 400 justice-involved individuals with mental health and/or substance use disorders that limit one or more of their life activities. The Office of the Public Defender intends to both supplement existing intensive services and expand services, including additional prevention/early intervention diversion services that align with restorative justice principles and evidence-based models. The program will focus on increasing the progression and recovery rate of the target population by providing local mental health services and substance use disorder services such as residential treatment, outpatient treatment, and sober living environments. The project addresses current gaps in providing mental health and substance use disorder support to the County’s underserved rural and lower income populations.
A portion of this funding will be used to increase operational capabilities of the Salinas Sobering Center, shifting the Center from part-time to 24/7 operations. The Center provides an intervention program that administers to a participant’s level of intoxication from alcohol and other drugs in a supportive short-stay environment overseen by qualified on-site staff. The services provided by the Center save law enforcement time and money, contribute to public health and community safety, and provide an avenue to connect receptive individuals with additional substance use treatment and/or other supportive services and resources.
The program team will consist of a Program Director, 1.0 FTE Management Analyst III. In addition, contractual services will be engaged for Substance Use Disorder Treatment Services, Mental Health Services, Transportation Services, Wrap-around Supportive Services, Housing Resources, and Evaluation/Assessment Services as required by the grant to evaluate program effectiveness.
OTHER AGENCY INVOLVEMENT:
County Counsel’s Office, the Auditor-Controller’s Office, and Risk Management have reviewed and approved as to form.
FINANCING:
As the grant award occurred after the adoption of the Fiscal Year’s 2024-2025 Budget, the associated revenue and expenditures are not included in the Department’s operational budget for the current year. The Department will evaluate the need to increase revenue and appropriations and will return to the Budget Committee if necessary.
