RECOMMENDATION:
It is recommended that the Board of Supervisors:
a.      Approve Professional Services Agreement with Benchmark Land Use Group, Inc. dba Benchmark Resources for State of California Surface Mining and Reclamation Act (SMARA) annual inspection services (RFP #10443) for a total amount not to exceed $389,720 for a term of April 1, 2014 to December 31, 2017 with the option to extend the term for one (1) optional one-year period; and
b.      Authorize the Contracts/Purchasing Officer to execute the Professional Services Agreement and future amendments to the Agreement where the amendment does not significantly alter the scope of work or change the approved Agreement amount.
 
SUMMARY/DISCUSSION:
The Professional Services Agreement (PSA) provides for State of California Surface Mining and Reclamation Act (SMARA) annual inspection services for the County of Monterey Resource Management Agency - Planning (Request for Proposals No. 10443) in an amount not to exceed $389,720 for a term of April 1, 2014 through December 31, 2017. There are currently sixteen (16) mine operations in the County and this PSA will provide for annual mine inspections and condition compliance review as required by SMARA for a period of four (4) years with the option to extend the term of the PSA for one (1) optional one-year period with inspections to be completed by December 31st of each year.  Benchmark Land Use Group, Inc. dba Benchmark Resources was selected to provide these services through a competitive selection process in accordance with County policies and State laws.

FINANCING:
It is anticipated that there will not be an impact to the General Fund.  Services provided under this PSA are funded by the Surface Mine Annual Inspection Fee paid by mine operators to the County.
