Title: a. RECOMMENDATION:

It is recommended that the County of Monterey Board of Supervisors:

a.  Approve and authorize the Director of Health Services or designee to execute a non-standard Agreement with CliftonLarsonAllen, LLP, to provide professional financial and compliance audit services, effective upon execution to June 30, 2024, for a total Agreement amount of $21,000; and

b.  Approve a non-standard Agreement as recommended by the Director of Health Services; and

c.  Approve and authorize the Director of Health Services or designee to sign up to three future amendments where the combined amendments do not exceed 10% ($2,100) of the original amount and do not significantly change the scope, total not to exceed a maximum of $23,100.

 

SUMMARY DISCUSSION:

On November 8, 2016, California voters passed Proposition 64, legalizing the nonmedical use of cannabis by adults 21 and older. In 2017, the County of Monterey Board of Supervisors adopted an ordinance that includes language that regulates adult-use and medical commercial cannabis activities for the unincorporated areas of Monterey County. Some local cities also adopted ordinances to allow commercial cannabis activities.

 

Currently, the County and seven cities operate cannabis businesses that include brick and mortar outlets, delivery, manufacturing, testing, distribution, and cultivation that includes cannabis and hemp. Monterey County’s State issued cannabis cultivation license allows for approximately 3,036,673 square feet of nursery, indoor, mixed light, and outdoor cultivation activities, which ranks sixth in the State for square footage dedicated to cannabis cultivation activities.   

 

To support public health efforts to educate and protect at-risk populations from adverse health effects of cannabis use, the County of Monterey Health Department applied for and was awarded a Board of State and Community Corrections (BSCC) Proposition 64 Public Health and Safety Grant.  As a recipient of this grant, the County of Monterey Health Department is required to provide the BSCC a financial audit by the end of the contract term (March 31, 2024).  The financial audit must be performed by a Certified Public Accountant or a participating county or city auditor that is organizationally independent from the participating county project financial management functions.

This work supports the County of Monterey Health Department 2018-2024 Strategic Plan Goal: 4. Engage Health Department workforce and improve operational functions to meet current and developing population health needs. It also supports two of the ten essential public health services, specifically: 5. Create, champion, and implement policies, plans, and laws that impact health, and 9. Improve and innovate public health functions through ongoing evaluation, research, and continuous quality improvement.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel has reviewed and approved this Agreement as to legal form. Auditor-Controller has reviewed and approved this Agreement as to fiscal provisions.

 

FINANCING:

This agreement is funded 100% by a BSCC Proposition 64 Public Health and Safety Grant).  There are sufficient appropriations in the Health Department’s (001-4000-8124-HEA003) FY 2023-24 Adopted Budget.
