RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve an automatically self-renewing agreement between the County of Monterey (Lessee) and Hubert Schwab (Lessor) for the County to install, operate and maintain a radio transmitter and receiver station on Hubert Schwab's property; and
b. Authorize the chair of the Board to sign and execute the agreement.
SUMMARY/DISCUSSION:
The Parks Department has maintained a similar agreement with Mr. Schwab since June 27, 2000. The relationship between both parties has allowed the department to maintain and operate a radio transmitter and receiver station located on his property. The receiver station allows the Park Rangers to transmit public safety information for the south county while performing their duties as first responders to medical calls, law enforcement, and requesting fire dispatch. The history between Schwab and the County of Monterey has always been cooperative and there have been no known negative incidents.
The Parks Department was contacted by the Information Technology (I.T.) Department, Telecommunications Division, with the intent of expanding the footprint of the existing tower in order to increase the viable connectivity between Pinball Hill, Monterey County, and San Luis Obispo County. The intent was to benefit both county agencies and all local law enforcement agencies which may have the current or future capability to access the radio transmitter. The proposed agreement will provide a more stable radio communication for Southern Monterey County.
OTHER AGENCY INVOLVEMENT:
County Counsel has reviewed and approved the agreement to form. The Parks Department has worked to finalize the agreement specifications in collaboration with the I.T. Department, Telecommunications Division and the I.T. Director concurs with the requested action.
FINANCING:
There is an initial one-time cost for road base work in the amount of $13,450 which the I.T. Department has agreed to reimburse the Lessor for the cost of one-half the amount ($6,725 per the Agreement Section 10). The Parks Department will have an increased annual lease cost of $1,400, previously $700, commencing in Fiscal Year 2013-14. The annual lease will increase by $300 every five (5) years, thereafter. The increase will be absorbed by the Parks Department Lakes Enterprise Fund Administrative Unit 8391. There is no adverse impact to General Fund Contribution as a result of this action.
