RECOMMENDATIONS:
It is recommended that the Board of Supervisors:
 
a. Approve and authorize the Chair of the Board to certify and submit electronically a Notice of Intent to the State Water Resources Control Board for a reissued five-year Municipal Stormwater General Permit; and
 
b. Authorize and appoint the Director of Public Works as a Duly Authorized Representative to certify and submit future annual reports to the State Water Resources Control Board.
 
SUMMARY:
In order to register for, and meet the terms of, the recently reissued Municipal Stormwater General Permit, a Notice of Intent must be submitted to the State Water Resources Control Board prior to the July 1, 2013 effective date.
 
DISCUSSION:
The County of Monterey holds a permit from the State Water Resources Control Board (SWRCB) to operate its storm drain systems in the unincorporated urbanized areas of the County.  As a Permittee (Discharger), the County is required to reduce the pollutants that are discharged from its storm drain systems to the maximum extent practicable.
 
On February 5, 2013, the State Water Resources Control Board reissued the Municipal Stormwater General Permit for Discharges from Small Municipal Separate Storm Sewer Systems (MS4s) as required by law on a five-year permit cycle.
 
The new General Permit requires the County to register by filing a Notice of Intent electronically prior to the July 1, 2013 effective date of the reissued Permit.  Permittees are required to submit a map of the area covered under its Permit (Exhibit 1) and a Guidance Document (attached Phase II Small MS4 General Permit Document) that outlines the measures the Permittee will employ to minimize pollutants and meet the minimum standards set forth in the Permit.  An $18,196 application fee is also due within 60 days of the submittal date.  
 
In addition, the General Permit requires each Permittee to submit electronically an annual report describing its implementation of the General Permit, assessing the effectiveness of its program, and identifying areas where improvements can be made.  Each annual report must be certified and submitted by a Duly Authorized Representative, typically the Public Works Director, the Stormwater Program Manager, or another senior-level stormwater program staff member.
 
OTHER AGENCY INVOLVEMENT:
The Monterey Regional Stormwater Management Program which includes representatives from eight participating member municipalities is developing the Guidance Document to be used.
 
FINANCING:
There is no impact to the General Fund.  The County's $18,196 application fee was anticipated and was included in its FY 2013-14 baseline budget submissions.  The General Fund provides $150,000 annually to fund the stormwater program; this permit fee has been budgeted within the annual $150,000 allocation.  Other Permit and participation fees will be due and payable annually in accordance with the terms and conditions of each Permit and Agreement.
