RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Authorize the Contracts Purchasing Officer or Contracts Purchasing Supervisor to execute an agreement between the Sheriff’s Office and the California Department of State Hospitals (DSH), to continue the regional Jail Based Competency Treatment program (JBCT), effective July 1, 2023, to June 30, 2026, in the amount of $6,777,678; and

b. Adopt a resolution authorizing and directing the Auditor-Controller to amend the Sheriff’s FY 2023 24 Adopted Budget by increasing appropriation in 001-2300-SHE003-8238 in the amount of $346,435 financed by the increase in revenue from the DSH in 001-2300-SHE003-8238. (4/5ths Vote Required)

 

SUMMARY/DISCUSSION:

On September 10, 2019, the Monterey County Board of Supervisors unanimously approved a contract between the Monterey County Sheriff’s Office (MCSO) and DSH to host a regional JBCT, aimed at restoring to competency those inmates charged with felonies and found by the courts to be incompetent to stand trial, with board order A-14494.

 

Due to the continued overwhelming need for beds and program space for inmates found by local Superior Courts to be incompetent to stand trial, DSH has requested that MCSO continue the program for at least another three (3) years.

 

The program will continue to provide service to inmates in Santa Cruz and San Benito Counties as well. The program has proven to be effective in getting inmates into treatment and restored to competency.

 

The number of incarcerated people in the Monterey County Jail with mental health issues continues to grow. The JBCT has a set curriculum, established by the DSH, and administered by Wellpath. This curriculum includes classroom environment programming, counseling, and a therapeutic living environment that fosters socialization with other program participants. Where necessary it would also include individual work with program participants.

 

The program currently operates as an 11-bed program, however, in July 2023, the program will operate as a 13-bed program, adding two (2) additional beds to accommodate a maximum of 13 inmates at any time. 

 

The Sheriff’s Office had already included the JBCT program in the FY 2023-24 budget for the 11 beds, however, the two (2) additional beds approved by DSH increase Appropriations and Revenue by $346,435 and will need to be incorporated in the Sheriff’s Budget.

 

OTHER AGENCY INVOLVEMENT:

The Budget Committee supported this request on June 28, 2023. County Counsel and the County Administrative Office have reviewed.

 

FINANCING:

The Sheriff’s Office is requesting an increase in Appropriations for FY 2023-24 totaling $346,435 that will be financed by the increased revenues from DSH. There is no additional General Fund Contribution as a result of this action.
