a. Approve Amendment No. 7 to the Standard Agreement, Multi-Year Agreement #3200*2166, with Western Oilfields Supply Company dba Rain for Rent to provide labor and equipment rental for common storm water pumping system elements required for storm water pumping projects to increase the not to exceed amount by $165,000 for a total amount not to exceed $350,000 with no extension to the term from May 1, 2016 to April 30, 2024; and
b. Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment No. 7 to the Standard Agreement and future amendments to the Agreement where the amendments do not significantly alter the scope of work or increase the approved Agreement amount.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 7 to the Standard Agreement, Multi-Year Agreement #3200*2166, with Western Oilfields Supply Company dba Rain for Rent to provide labor and equipment rental for common storm water pumping system elements required for storm water pumping projects to increase the not to exceed amount by $165,000 for a total amount not to exceed $350,000 with no extension to the term from May 1, 2016 to April 30, 2024; and
b. Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment No. 7 to the Standard Agreement No. and future amendments to the Agreement where the amendments do not significantly alter the scope of work or increase the approved Agreement amount.
SUMMARY/DISCUSSION:
Amendment No. 7 to the Standard Agreement (SA) with Western Oilfields Supply Company dba Rain for Rent (Rain for Rent) will allow for an increase to the not to exceed amount of $185,000 by $165,000 for a total amount not to exceed $350,000 to continue to allow labor and equipment rental for common storm water pumping system elements required for storm water pumping projects and as needed by the County of Monterey (County) Department of Public Works, Facilities and Parks (PWFP). PWFP is currently developing a Request for Proposals (RFP) (RFP #10886) for these services. Additional time is needed while RFP #10886 is published, and Contractor selection is made.
PWFP has a need for labor and equipment rental for common storm water pumping system elements required for storm water pumping projects involving dewatering operations, emergency backup pump installation, and pump servicing at County facilities. These services are often requested with very short notice due to equipment failure or weather conditions, and require quick response times, often within two hours or less. During the recent 2023 winter storms, multiple backup pumps were used for flood fighting operations and dewatering operations were set up to facilitate the repair of County infrastructure.
PWFP staff recommends that the Board of Supervisors approve the proposed Amendment No. 7 (Attachment A) to the SA with Rain for Rent to continue to allow labor and equipment rental for common storm water pumping system elements required for storm water pumping projects at various locations within Monterey County. Amendment No. 7 will increase the not to exceed amount of $185,000 by $165,000 for a total amount not to exceed $350,000 with no extension to the term ending on April 30, 2024, and further include Federal Emergency Management Agency (FEMA) provisions to the SA.
Attachments B through J, provided for reference, include the SA, Amendments No. 1 through 6 to the SA, a summary of the SA and its annual expenditures and balance to date.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and the Auditor-Controller’s Office have reviewed and approved Amendment No. 7 as to form, and fiscal provisions, respectively.
FINANCING:
Estimated costs for the proposed Amendment No. 7 over the current fiscal year (FY) 2023-24 are $165,000. There is no minimum or maximum amount allocated per budget unit. Services may be requested as needed, provided funds are available within the FY adopted budget.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The recommended action supports the Board of Supervisors’ Strategic Initiatives for Health and Human Services and Public Safety. The proposed Amendment No. 7 will allow the County to continue maintenance of County facilities. Properly functioning storm water pumping systems prevent public and environmental health risks.
