RECOMMENDATION:
It is recommended that the Board of Supervisors:
a.      Approve and ratify the contract award for Monterey County RFP #10370 to Learning Time, Inc. to provide learning disability assessments for CalWORKs customers; and
b.      Approve and ratify the execution of the agreement with Learning Time, Inc. by the Purchasing Manager on August 22, 2012 for the period July 1, 2012 - June 30, 2013.
 
SUMMARY/DISCUSSION:
On May 4, 2012, the County circulated a Request for Proposals (RFP#10370) for the provision of learning disability evaluations and related services for all adult Welfare-to-Work customers. Proposals were due on June 1, 2012, and two (2) proposals were then evaluated by screeners on behalf of the Department of Social and Employment Services.  The proposal from Learning Time, Inc. was determined to be the most responsive and DSES staff initiated negotiations with them regarding the specific contract terms and scope of services.  The resultant contract provides for referred adult Welfare-to-Work customers to be evaluated to identify specific learning disabilities. Learning Time Inc. meets with referred customers and conducts the evaluation at One Stop Career Centers in Seaside, Salinas and King City and then prepares written evaluation results and recommendations regarding the potential impact for employment and participation in Welfare-to-Work activities.  The Learning Disability Evaluation Report is used to help customers design and implement an effective Welfare-to-Work Plan that can lead towards self-sufficiency.   
 
The RFP process was conducted in accordance with standard Monterey County RFP procedures, including an evaluation process that determined the Learning Time, Inc. proposal was the most qualified and responsive to meet the needs of the County.  The County received a protest appeal to RFP #10370 on June 21, 2012 from Ms. Rita Rispoli.   After multiple contacts between County staff and Ms. Rispoli, the allegations of the appeal were investigated and then denied by the County on July 12, 2012.  The denial of the appeal was based on a determination that there were no identifiable irregularities in the circulation, review, or preliminary determination of the award process. The contract with Learning Time, Inc. is being brought before the Board for approval at this time to ratify the selection process and departmental decision regarding the selection of Learning Time as the provider, and ratify the administrative processing of the 'under $100,000' agreement.
 
OTHER AGENCY INVOLVEMENT:
County Counsel and the Auditor Controller have approved the agreement with Learning Time.
 
FINANCING:
This agreement is funded by the CalWORKs Single Allocation. Sufficient appropriations and estimated revenues in SOC005 are included in the FY 2012/13 Adopted Budget. Approval of this action has no impact on the County General Fund.
