RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.  Authorize the Contracts/Purchasing Officer, or their designee, to execute an amendment to the ten-year non-standard Agreement with AXON Enterprise, Inc. for Digital Evidence Management, increasing the maximum amount from $950,832 to $1,982,205, with no change to the contract term ending June 30, 2034;

b.  Accept non-standard contract provisions as recommended by the District Attorney;

c.    Authorize the Contracts/Purchasing Officer or their designee and the District Attorney or their designee to sign and execute the appropriate documents and verifications when required;

d.  Authorize the Contracts/Purchasing Officer or their designee to issue purchase orders on an as-needed basis pursuant to this Amended Agreement of the period of June 1, 2024, through June 30, 2034.

SUMMARY:

On June 4, 2024, the Board approved a ten-year non-standard agreement with AXON Enterprise, Inc. in the amount of $950,832, covering the period of July 1, 2024, through June 30, 2034, to provide cloud-based digital evidence management services for the District Attorney’s Office.

 

AXON’s system securely stores digital evidence, including body-worn camera footage and other large multimedia files, on a DOJ-compliant cloud platform. This reduces demand on County servers, improves accessibility, and ensures long-term data integrity and security. The system has become a critical tool for managing the increasing volume and complexity of digital evidence required in criminal prosecutions.

 

This request is to amend that agreement to increase the not-to-exceed amount to $1,982,205. The additional cost reflects the upgrade to AXON’s Justice Premier interface, which does not change the underlying system but provides a significantly improved user experience. Justice Premier offers enhanced tools for reviewing, tagging, organizing, and sharing digital evidence. These features are expected to improve workflow efficiency and accessibility for attorneys and staff managing complex cases.

 

The amendment also aligns with the mutual termination of a previously approved agreement with NICE Systems, which was intended to provide similar functionality. Unspent and refunded funds from that contract will be reallocated to support this upgrade under AXON.

 

DISCUSSION:

AXON Enterprise, Inc. currently provides video capture systems to several law enforcement agencies in the County. The video and digital files generated through these systems are used as evidence in criminal cases. These files are large and require secure, long-term storage.

 

To manage this, the District Attorney’s Office uses AXON’s cloud-based Digital Evidence Management System (DEMS), which integrates with existing technology and reduces reliance on County servers by storing files securely in the cloud. The services provided by AXON Enterprise, Inc., are part of an RFP issued by the University of Nebraska, making AXON’s services available to other public agencies nationwide, including the County of Monterey.

 

We are now requesting to amend the agreement to increase the total contract amount. This increase will pay for AXON’s Justice Premier upgrade, which keeps the same storage system but adds a new, easier to use interface. Justice Premier will help attorneys and staff review, organize, and manage evidence more efficiently, while also improving evidence sharing and accessibility for our justice partners.

 

This change comes after a separate contract with NICE Systems, which was meant to provide similar services, was ended by mutual agreement. Funds from that terminated contract - including any refunds - will be used to support the upgrade with AXON. This will allow the County to continue using a single, integrated evidence management system that better meets current needs.

 

OTHER AGENCY INVOLVEMENT:

County Counsel has approved the agreement as to legal form.

 

FINANCING:

The Fiscal Year 2024-25 Adopted Budget for the District Attorney, Appropriation Unit DIS001, Unit 8063 includes sufficient appropriations for this amendment.  Funding for this Agreement in Fiscal Year 2025-26 was included the District Attorney’s Recommended Budget.  Ongoing costs will be included in the budget approval process. There will be no increase in the General Fund Contribution resulting from this Board action.
