RECOMMENDATIONS:
It is recommended that the Board of Supervisors:
 
a. Authorize an additional contingency of 5% of the contract amount with R.M. Harris Co. Inc., for the Schulte Road Bridge at Carmel River, County Bridge No. 501, State Bridge No. 44C-0115, Project No. 382065, State Project No. EA 05-141004L, Federal Aid Project No. BRLO-5944 (010), to provide funding for approved contract change orders; and
 
b. Authorize the Director of Public Works to execute contract change orders where the total value of change orders does not exceed 15% of the original contract amount, and do not significantly change the scope of work.
 
SUMMARY/DISCUSSION:
On March 20, 2012, the Board of Supervisors awarded Agreement No. A-12195 to R.M. Harris Co. Inc., for the Schulte Road Bridge at Carmel River, County Bridge No. 501, State Bridge No. 44C-0115, Project No. 382065, State Project No. EA 05-141004L, Federal Aid Project No. BRLO-5944 (010) (Bridge Project), in the total amount of $2,802,499.  As part of this action, the Board also authorized a contingency (not to exceed 10% of the contract amount) to provide funding for approved contract change orders; the Director of Public Works to execute the contract; and subject to the terms of the Public Contract Code, approve change orders to the contract that do not exceed 10% of the original contract amount, and do not significantly change the scope of work.  Construction began in June 2012 and is expected to be completed by the end of 2013.
 
During the course of construction, contract change orders have been executed to address unexpected field conditions and additional work requests by California American Water Company (Cal-Am) and the Monterey Peninsula Water Management District (District).  Cal-Am requested additional piping components to improve the function of the waterline.  This resulted in Contract Change Order No. 9 in the amount of $44,439.92 to procure and install the additional pipe components.  Cal-Am has agreed to reimburse the County the additional $44,439.92 cost associated with the relocation of their waterlines.
 
The District has requested that additional armoring of the river channel be installed within the limits of the Bridge Project to protect the river bank from scouring and erosion.  The District has also requested that any concrete rubble uncovered during the course of construction be removed and replaced with new granite rip rap.  This request resulted in a contract change order of approximately $45,000.  The cost for this work will be paid by the Bridge Project with the Federal and State funding allocated for the project.
 
To date, the total approximate sum of the total contract change orders is $230,000 and does not exceed the 10% contingency amount originally authorized by the Board for this Bridge Project.  However, the remaining contingency amount is approximately $50,000 and may not be enough to complete a project of this size and nature.  The additional contingency is being requested at this time to avoid any potential delays in the construction due to lack of contingencies funding.
 
OTHER AGENCY INVOLVEMENT:
The Resource Management Agency worked closely with Cal-Am and the District to determine the most efficient and cost-effective course of action for this project.  The Caltrans Local Assistance Office was also consulted in regards to the Federal funding.  
 
FINANCING:
There is no financial impact to the General Fund for the construction phase of the Bridge Project.  Total estimated project cost, including project management, engineering, utility relocation and construction is $5,863,838.  The construction phase of the project is budgeted for $3,222,873 which will be funded by Federal Highway Administration (FHWA) funds for an amount of $2,673,004, State Seismic Funds $346,316 and California American Water Company $203,553.
