RECOMMENDATION:
It is recommended that the Board of Supervisors:
Approve and authorize the Director of Health or designee to execute, on behalf of the County of Monterey, grant applications and agreements, and any amendments thereto, for the Certified Unified Program Agency (CUPA) Electronic Reporting Grant agreement between the California Environmental Protection Agency (Cal/EPA) and the Monterey County Health Department and ratify said approval and authorization to relate back to the April 6, 2011 application submittal date.
 
SUMMARY/DISCUSSION:
On April 6, 2011, an application was submitted to the Cal/EPA requesting participation by the Monterey County Health Department in Cal/EPA's CUPA Electronic Reporting Grant (Attachment A).   Pursuant to the California Health & Safety Code, Division 20, Chapter 6.11, Unified Hazardous Waste and Hazardous Materials Management Regulatory Program, Section 25404 et seq., the CUPA Electronic Reporting Grant was established to provide funding to eligible CUPAs, such as the Health Department, Environmental Health Bureau, for assistance in implementing electronic reporting requirements.  
 
Based on the subsequent grant agreement provided by Cal/EPA and executed by both parties in August 2011, a grant was approved for $102,794.00 and an advance payment of $25,698.50 was distributed to the Environmental Health Bureau (Attachment B).  The State is authorized to enter into such agreements per California Health & Safety Code Section 25404 et seq.  
 
Prior Board authorization to apply for the subject grant and execute the grant agreement provided by Cal/EPA on behalf of the Health Department was not timely requested in 2011. Therefore, the Director of Health requests that the Board retroactively provide approval and authorization for the Director of Health or designee to execute, on behalf of the County of Monterey, the identical grant application and agreement, and any subsequent amendments thereto, for the CUPA Electronic Reporting Grant agreement between Cal/EPA and the Health Department to relate back to the April 6, 2011 application submittal date.
 
The CUPA Electronic Reporting Grant would support implementation of electronic data reporting requirements by providing grant funds to purchase and install equipment and software, to pay for data management consultation services, and to defray the costs of training Environmental Health staff as well as the CUPA-regulated business community in order to assure the Electronic Reporting Program's success.  The grant agreement obligates Environmental Health to perform specific tasks and to coordinate with Decade Software, as described in the grant agreement, to develop the necessary communication standards for two-way CUPA related data transfer between the State's enterprise data base and Environmental Health's enterprise data base.
 
OTHER AGENCY INVOLVEMENT:
The CUPA Electronic Reporting Program Grant Manger has been consulted with regard to the proposal to retroactively provide Board approval and authorization for the Director of Health or the Director's designee to execute the identical grant application and agreement, and any subsequent amendments thereto, to relate back to the April 6, 2011 application submittal.  The Grant Manager concurs with this recommendation.
 
FINANCING:
Appropriations and revenues related to the subject grants have been included in the Health Department Budget for FY 2012-13.  There will be no new General Fund Contribution resulting from this action.
