RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve Amendment No. 1 to Standard Agreement No. A-15190, Multi-Year Agreement #3200*5629, with SCA of CA, LLC to provide National Pollutant Discharge Elimination System (NPDES), on-call and emergency street sweeping services, Request for Proposals #10784; extend the expiration date for one additional year through March 31, 2025, for a revised term of April 1, 2021 to March 31, 2025, with the option to extend the term for one additional 1-year period, and increase the not to exceed maximum by $184,414 to a total amount of $569,514; and

b. Authorize the Contracts & Purchasing Officer or their designee to execute Amendment No. 1 to Standard Agreement No. A-15190 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or increase the approved Agreement amount.

 

SUMMARY:

The recommended actions would allow for the approval of Amendment No. 1 (Attachment A) to Standard Agreement (SA) No. A-15190 with SCA of CA, LLC (SCA) in the amount of $184,414 to provide services for street sweeping of public roads and streets within the unincorporated areas of the County of Monterey and are a part of the State-mandated National Pollutant Discharge Elimination System (NPDES) Stormwater Phase II Municipal General Permit which requires the roads and streets to be swept twice a year.  Included in the $184,414 amount is $16,765 as a contingency for on-call and emergency sweeping services as needed.

 

DISCUSSION:

In April 2021, SCA (formerly Contract Sweeping Services, LLC) was selected as the most qualified bidder, for their expertise and capabilities necessary to provide NPDES, on-call and emergency street sweeping services solicited under a competitive selection process in accordance with County policies and State laws as set forth under RFP #10784. 

 

PWFP has identified a need to extend the term and increase the amount of the SA to continue to provide required State-mandated NPDES Stormwater Permit, on-call and emergency street sweeping services for the public roads and streets within the unincorporated areas of Monterey County.  PWFP staff recommends that the County of Monterey Board of Supervisors approve the proposed Amendment No. 1 (Attachment A) to the SA with SCA to continue to allow for required scheduled street sweeping services.  Amendment No. 1 will extend the expiration date for one additional year through March 31, 2025, for a revised term of April 1, 2021 to March 31, 2025, with the option to extend the term for one additional 1-year period and increase the not to exceed amount of $385,100 by $184,414 for a total amount not to exceed $569,514.

 

Attachments B, C and D, provided for reference, respectively include an Assignment and Assumption of Contract to SA No. A-15190, the SA, and a summary of the SA and its annual expenditures and balance to date.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel and the Auditor-Controller’s Office have reviewed and approved Amendment No. 1 as to form, and fiscal provisions, respectively. 

 

FINANCING:

Costs associated with Amendment No. 1 are anticipated to be incurred over the next two (2) fiscal years (FY) 2023-24 and FY 2024-25, through March 31, 2025.  The annual cost for NPDES is $66,119.25.  The Adopted Budget for FY 2023-24 includes sufficient appropriations in the Road Fund 002, Appropriation Unit PFP004, to cover costs related to Amendment No. 1.  The amount required for FY 2024-25 will be included in that FY’s Recommended Budget. 

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The recommended action supports the Board of Supervisors’ Strategic Initiatives for Health & Human Services and Infrastructure.  The NPDES Stormwater Permit requires the County to sweep roads within designated urbanized areas twice annually, once in the Spring and once in the Fall, and is intended to reduce pollution entering storm drain systems.
