Title: a. RECOMMENDATION:
It is recommended that the Board of Supervisors:
 
a. Introduce, waive the reading, and set June 24, 2014 at 1:30 p.m., as the date and time to conduct a public hearing to consider adoption of an ordinance adding Article VII to section 12.44 of the Monterey County Code to make the California Vehicle Code, applicable to private roads in the East Garrison Phase One Subdivision, in the East Garrison area of the unincorporated area of the County of Monterey;
 
b. Direct RMA - Public Works to mail the Notice of Public Hearing to the affected landowners not less than ten (10) days prior to the date of hearing; and
 
c. Authorize the Clerk of the Board to publish the Notice of Public Hearing in the Monterey County Weekly.
 
SUMMARY/DISCUSSION:
The Director of Public Works of the County of Monterey Resource Management Agency has received a petition (attached) from UCP East Garrison, LLC to make roads in the East Garrison Phase One development subject the California Vehicle code and enforceable by the CHP.  The request is to consider all of the non County Maintained roads created by the East Garrison Phase One Final Map, recorded on June 28, 2007, in the Office of the Recorder of the County of Monterey at Volume 24, Cities and Towns, at page 7.  The roads are solely owned and maintained by UCP East Garrison, LLC.  The subdivision lots are owned by various Property Owners (list attached).
 
Resource Management Agency - Public Works (RMA-PW) Staff has reviewed the request and determined the public would benefit from this action by allowing UCP East Garrison LLC the option of enforcement to address issues that arise along their roadways.  RMA-PW Staff is recommending the adoption of the attached Ordinance.
 
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel has approved the Ordinance as to form.  The California Highway Patrol concurs with this recommendation.
 
FINANCING:
There is no financial impact to the General Fund.
