Title: a. RECOMMENDATIONS:
It is recommended that the Board of Supervisors:
a.  Accept a Grant of Public Utility Easement over a portion of APN 031-161-023 ("East Garrison Parcel D") from the Successor Agency to the Redevelopment Agency of the County of Monterey, for purpose of ingress and egress, and constructing, maintaining, using, and operating utility connections in conjunction with the East Garrison Development Project on the former Fort Ord;
b.  Approve and authorize the Chair to execute the Certificate of Acceptance and Consent to Recordation for the Grant of Public Utility Easement; and
c.  Authorize the Director of Public Works to submit the executed Grant of Public Utility Easement to the County Recorder for recordation.
 
SUMMARY:
Acceptance of the Grant of Public Utility Easement (Easement) will provide the County with access to a portion of property previously owned by the Redevelopment Agency of the County of Monterey (Agency) in the "Phase 3" area of East Garrison for the purpose of ingress and egress to construct, maintain, use, and operate public utilities as part of the infrastructure necessary to serve development of the East Garrison Development Project.
 
DISCUSSION:
On October 5, 2005, the Board of Supervisors approved the Conditional Use Permit and Tentative Subdivision Map for the East Garrison Development Project (Project).  On June 22, 2007, the Board approved the Final Subdivision Map for Phase 1 of the development.  
 
The Agency retained ownership of several parcels of land in the "Phase 3" area of the Project, including the 8.3-acre "Parcel D" (APN 031-161-023) designated for future construction of a recreational facility and historical improvements.  Implementation of the Project will require the construction of public utilities to serve the site.  Acceptance of the Easement will allow public utility companies to construct, maintain, use and operate utility systems serving the East Garrison development along the edges of the subject property.
 
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel has reviewed and approved the Easement with the Certificate of Acceptance and Consent to Recordation as to form.  The Board of Supervisors, acting as the Board of Directors of the County of Monterey, as Successor Agency to the Redevelopment Agency of the County of Monterey, has approved the Easement.
 
FINANCING:
There is no impact to the General Fund.  The cost for processing the Easement will be funded by developer fees.  Costs associated with construction, maintenance, and operation of public utilities will be funded by the various utility companies.
