a. Approve and authorize the Contracts/Purchasing Officer or their designee to execute Renewal and Retroactive Amendment No. 3 to Agreement No. A-16556 with SCRAM of California, Inc. to provide electronic monitoring products and services for Probation clients, to renew and extend the expiration date of June 30, 2024 for one (1) additional year, for a revised term of June 1, 2023 through June 30, 2025, and to increase the Agreement’s amount by $200,500 for a revised total Agreement amount not to exceed $500,721; and
b. Authorize the Contracts/Purchasing Officer or their designee to execute future amendments to the Agreement where the total amendments do not exceed 15% ($75,108) of the Agreement amount and do not significantly change the scope of services, for a not to exceed maximum amount of $575,829.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Contracts/Purchasing Officer or their designee to execute Renewal and Retroactive Amendment No. 3 to Agreement No. A-16556 with SCRAM of California, Inc. to provide electronic monitoring products and services for Probation clients, to renew and extend the expiration date of June 30, 2024 for one (1) additional year, for a revised term of June 1, 2023 through June 30, 2025, and to increase the Agreement’s amount by $200,500 for a revised total Agreement amount not to exceed $500,721; and

SUMMARY/DISCUSSION:
The County of Monterey, Probation Department, entered Standard Agreement No. A-16556 (Agreement) with SCRAM of California, Inc. (Contractor) for a term of June 1, 2023 through December 31, 2023 and for an amount not to exceed $145,655 for an electronic monitoring program for the supervision of Probation clients as mandated by the Monterey Superior Court or as part of the probation supervision terms for the various offender populations under probation. The Agreement was subsequently amended through Amendment No. 1 to extend the term through June 30, 2024 and to increase the Agreement’s amount by $14,566 for an updated not to exceed amount of $160,221. The Agreement was further amended through Amendment No. 2 to increase the Agreement’s not to exceed amount by $140,000 for an updated Agreement amount not to exceed $300,221 and with no change to the existing Agreement term of June 1, 2023 through June 30, 2024. Amendment No. 2 also revised the fees to include a reduced fee schedule negotiated by the parties.
The Probation Department (Probation) has a continued need for services and a term extension and an increase in funding is necessary to allow the Contractor to continue providing services. Amendment No. 3 has been drafted to extend the term of the Agreement for an additional year through June 30, 2025 and to increase the Agreement’s not to exceed amount by $200,500 for an updated Agreement amount not to exceed $500,721. In addition, Probation and the Contractor have negotiated a revised fee schedule that includes a tiered structure for the SCRAM Continuous Alcohol Monitoring + ETHERNET product which will provide a discounted rate per the number of clients averaged in the month. Because electronic monitoring is utilized as an intermediate sanction and detention alternative, the number of clients monitored can fluctuate per month. The revised fee schedule provides a tiered structure that will benefit the County and Contractor and will allow the parties to continue collaborating on the services under the Agreement in the most cost effective manner.
Probation recommends the approval of Amendment No. 3 as it will allow the Contractor to continue providing services vital to the operations of the Probation Department.
OTHER AGENCY INVOLVEMENT:
Amendment No. 3 was approved by the Office of County Counsel as to legal form and by the Auditor-Controller as to fiscal terms.
FINANCING:
The associated funding and appropriations of $200,500 for the FY 24-25 fiscal year are included in the Probation Department’s FY 24-25 Adopted Budget (PRO001 - Unit 8165). There is no additional cost to the County General Fund with this recommendation.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
This recommendation supports the Board of Supervisor Strategic Initiatives of Public Safety by supporting Probation’s Electronic Monitoring Program. Probation utilizes electronic monitoring as a probation supervision tool for a number of different offender populations. Electronic monitoring serves as an intermediate sanction/detention alternative, as well as a tool to enhance public safety, by assisting officers in monitoring high risk populations in the community.
