RECOMMENDATION:
 
It is recommended that the Board of Supervisors:
a. Approve and authorize the Contracts/Purchasing Officer to sign an Agreement between the County of Monterey and The Gordian Group for the provisions of providing the County with a Job Order Contracting (JOC) System, effective from the date of execution through and including April 1, 2016; and  
b. Approve and authorize the Contracts/Purchasing Officer to exercise the option to extend the Agreement for two (2) additional one-year (1) terms.
SUMMARY/DISCUSSION:
 
Public Works Contract Code Section 20128.5 provides that counties may award annual contracts for repair, remodeling or other repetitive work to be done according to unit prices.  This is commonly referred to as Job Order Contracting (JOC), and is typically done by developing a construction task catalog that is then competitively bid.  If approved by your Board, job order contracting will improve economy and efficiency in completing many public works projects, including urgent and time sensitive projects.  Currently, sixteen California Counties and many public agencies across the country use the JOC process.  Staff recommends entering into a contract with the Gordian Group to assist the County with implementing a job order contract program for Monterey County because the Gordian Group has the qualifications and experience to provide the products and services necessary to implement and support a successful JOC program for County of Monterey.  
 
The job order contracting system proposed by the Gordian Group, Inc. uses an extensive catalog of construction tasks and associated technical specifications that contains over 260,000 individual items.  The catalog(s) that the Gordian Group will develop for the County will be specifically designed for Monterey County.  Each task within the catalog will be priced by the Gordian Group, Inc. in consideration of local construction costs (labor, equipment and materials) and will be specifically tailored for local needs and conditions. The Gordian Group shall prepare for, and participate in informational meetings with representatives from the Building Trades Councils, local unions and the construction community of the County of Monterey, County of Santa Cruz, and San Benito County, during the development and implementation of the proposed JOC program.  
 
Once developed, annual contract(s) will be awarded to the lowest responsible bidder and will be based on plans and specifications for typical work.  As individual projects at various sites throughout the County are identified, scope(s) of work will be developed and orders will be issued to the general contractor(s) for work to be performed.  Many of those projects may be performed simultaneously, and projects will be completed much faster, will be less costly, and will be tracked much more closely than currently possible.  Due to the nature of the contracts, the County is under no obligation to issue specific projects to a general contractor. Typically, a certain amount of work, such as $25,000, is guaranteed to the contractor to encourage bidding; this amount will be determined at a later date at the time of the actual bidding of the Job Order Contract.  
 
If approved by your Board, the Gordian Group will provide an integrated system incorporating program development, document development, procurement support, computer software, customized forms, management procedures, written manual, and ongoing training for County of Monterey employees and the local contractor business community and follow-up support as administered by the Contracts/Purchasing and Resource Management Agency- Public Works Divisions.
 
OTHER AGENCY INVOLVEMENT:
 
County Counsel has approved the Agreement as to form. The Auditor's Office and Risk Management has approved each Agreement.
 
FINANCING:
 
Funds for these services are contained within the approved budget allocations of each individual department that may choose to utilize the JOC services. Expenditures will depend on the actual services requested by individual County departments. There are no upfront costs to develop the JOC program for Monterey County. A five percent (5%) License Fee to utilize the JOC program are payable only if and when a Job Order is issued to a JOC Contractor.
