a. Approve and authorize the Director or designee of the Department of Social Services to sign a Memorandum of Understanding (MOU) No. AAA-2425-32 with the California Department of Aging to establish responsibilities and provides the state authority to release funding to the County for designated programs for the period of July 1, 2024 through June 30, 2029; and

b. Authorize the Director or designee of the Department of Social Services to sign and execute all future amendments to this MOU.

 

Report

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and authorize the Director or designee of the Department of Social Services to sign a Memorandum of Understanding (MOU) No. AAA-2425-32 with the California Department of Aging to establish responsibilities and provides the state authority to release funding to the County for designated programs for the period of July 1, 2024 through June 30, 2029; and

b. Authorize the Director or designee of the Department of Social Services to sign and execute all future amendments to this MOU.

 

SUMMARY/DISCUSSION:

Through the Fiscal Year 2024-25 Governor’s Budget, the California Department of Aging (CDA) received $243.9 million to support the Older Californians Act (OCA) and Older Americans Act (OAA), which, in turn, supports California’s network of 33 Area Agencies on Aging (AAA), delivering services to adults aged 60 and older, individuals with disabilities, family caregivers, and residents in long-term care facilities. This fiscal year marks a transition for the CDA as it shifts from state revenue agreements between local AAAs to a multi-year Memorandum of Understanding (MOU). The County of Monterey Area Agency on Aging must enter into a multi-year MOU with the CDA to establish a legal relationship and responsibilities between CDA and the County so that the State can facilitate the transfer of OCA and OAA funding to the County. These programs provide assistance and related support services to eligible older adults (aged 60 and above), adults with disabilities, family caregivers, and residents in long-term care facilities within the County of Monterey service area.

 

The multi-year MOU between the CDA and County of Monterey AAA is valid for five years, effective July 1, 2024, and is renewed during the fifth year before expiration. The programs covered by this MOU include:

 

                     Title III B - Supportive Services & Ombudsman

                     Title III C-1 - Congregate Nutritious Meals

                     Title III C-2 - Home-Delivered Nutritious Meals

                     Title III C-1 and C-2 - Nutrition Services Incentive Program (NSIP)

                     Title III D - Preventive Health

                     Title III E - Family Caregiver Support Program

                     Title VII - Elder Abuse Prevention

                     Title VII - Long Term Care Ombudsman

                     Health Insurance Counseling and Advocacy Program (HICAP)

                     Medicare Improvements for Patients and Providers Act (MIPPA)

 

OTHER AGENCY INVOLVEMENT:

The Office of County Counsel has reviewed and approved the MOU as to form.

 

FINANCING:

There is no funding associated with this MOU but it does need to be executed before any funding can be released to the County for the OAA and OCA Titles III-B, III-C, III-D, III-E, VII, HICAP and MIPPA programs. CDA is streamlining their process by providing this MOU to outline responsibilities and establishing a legal relationship, it gives CDA authority to directly allocate funding received by CDA through the OAA and OCA to Monterey County’s AAA without the need to establish yearly contracts or amendments.  The MOU has a term of five (5) years, July 1, 2024 through June 30, 2029. 

 

Funding to the County will be issued once the Budget Act has been enacted or when CDA receives funding authority, A “Budget Display” will be sent to the County outlining the funding and timeframe for spending the funding.  The County will submit a budget to CDA for approval prior to the release of funds. 

 

On an average, Monterey County AAA receives $2,844,642 annually.  There is no change to the matching requirements of 10.53% for program dollars which is provided by our local contractors, and 25% match on administration which is provided by the AAA with the County General Fund Contributions provided within Fund 001-5010-SOC010-8268.  Appropriations and estimated revenues are included in the FY 2024-25 Recommended Budget and will be incorporated into future budget submissions.   There is no impact to the Department’s approved General Fund Contributions.
