a. Approve and authorize the Contracts/Purchasing Manager or Contracts/Purchasing Supervisor to sign Amendment No. 1 to Agreement A-13057 by and between County of Monterey and Cellebrite, Inc., for software and hardware support and upgrades for Universal Forensic Extraction Devices (UFED) used by the Sheriff’s Investigative Unit. This amendment adds $15,358.00 to the agreement, for a not to exceed amount of $43,000.00; and
b. Authorize the Contracts/Purchasing Manager or Contracts/Purchasing Supervisor to sign up to two (2) amendments to the agreement where the amendment does not significantly change the scope of work, and where the amendments in total do not exceed ten percent (10%) of the original contract amount ($2,764.00) for a cumulative, not to exceed total of $45,764.00.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and Authorize the Contracts/Purchasing Manager or Contracts/Purchasing Supervisor to sign Amendment #1 to Agreement A-13057 by and between County of Monterey and Cellebrite, Inc., for software and hardware support and upgrades for Universal Forensic Extraction Devices (UFED) used by the Sheriff’s Investigative Unit. This amendment adds $15,358.00 to the agreement, for a not to exceed amount of $43,000.00; and

SUMMARY:
The Sheriff requests approval of Amendment #1 to Agreement A-13057 with Cellebrite, Inc. to allow continued upgrading and continued usage of UFED units for the Investigative Unit.
DISCUSSION:
Your Board first approved this agreement in February 2016 as a grant purchase of equipment, using Sexual Assault Felony Enforcement (SAFE) funds. These units are invaluable to the Investigative Team as they aid in unlocking the data stored in mobile devices (GPS units, laptops, cellphones, tablets and memory cards). Today’s criminals use sophisticated technology to communicate and share data, and accessing that data is critical to conducting a successful investigation. The software also allows for unification of data from numerous sources and organizes data in an effective manner for the detectives. These devices can only be used after a search warrant has been issued to the Sheriff’s Office. UFED devices are deployed in over 30,000 locations worldwide. Cellebrite software can unlock and retrieve data from IPad, Iphone and other Apple devices.
Amendment #1 covers the trade-in of existing stand-alone units for computer based licenses, allowing for easier access to the Cellebrite product by all investigators. The trade in represents significant savings over purchase of new units/licenses. As indicated in the original board report, all ongoing costs for the hardware/software support are being paid from operational funding, because these devices are used in many types of investigations, not just for sexual assault cases.
OTHER AGENCY INVOLVEMENT:
County Counsel has approved the agreement as to legal form, the County Information Technology Department has reviewed the technical components of this contract, and the Auditor Controller has reviewed for fiscal provisions. Risk Management was unable to sign the original contract, because it limits Cellebrite’s liability to the amount paid to Cellebrite under this contract. The Sheriff respectfully requests approval of this Amendment, because the usage of the equipment is invaluable to investigators.
FINANCING:
The costs of the support were known at the time of budget construction, and were included in the FY 2017-18 approved budget. There will be no increase in General Fund Contribution as a result of this Board action.
