a. Approve Amendment No. 2 to the Agreement with North State Environmental to continue to provide services associated with hazardous waste management services to the County of Monterey Resource Management Agency - Public Works (Request for Proposal #10279), in the amount of $100,000 for a total amount not to exceed $199,900 from execution of the Agreement through and including September 15, 2014, with the option to extend the Agreement for two (2) additional one (1) year periods, in accordance with the terms and conditions of the Agreement; and
b. Authorize the Contracts/Purchasing Officer to execute Amendment No. 2 to the Agreement and future amendments to the Agreement where the amendments do not significantly alter the scope of work or change the Agreement amount.

RECOMMENDATIONS:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 2 to the Agreement with North State Environmental to continue to provide services associated with hazardous waste management services to the County of Monterey Resource Management Agency - Public Works (Request for Proposal #10279), in the amount of $100,000 for a total amount not to exceed $199,900 from execution of the Agreement through and including September 15, 2014, with the option to extend the Agreement for two (2) additional one (1) year periods, in accordance with the terms and conditions of the Agreement; and
b. Authorize the Contracts/Purchasing Officer to execute Amendment No. 2 to the Agreement and future amendments to the Agreement where the amendments do not significantly alter the scope of work or change the Agreement amount.
SUMMARY/DISCUSSION:
On October 4, 2011, the Contracts/Purchasing Officer executed the Agreement with North State Environmental in the amount of $95,000 to provide hazardous waste management services to the County of Monterey Resource Management Agency - Public Works (RMA-PW) from execution of the Agreement through and including September 15, 2014, with the option to extend the Agreement for two (2) additional one (1) year periods (Exhibit 1). North State Environmental was selected for their expertise and capabilities necessary to provide these services through a competitive selection process in accordance with County policies under Request for Proposal #10279.
On April 23, 2013, the Contracts/Purchasing Officer executed Amendment No. 1 to the Agreement in the amount of $4,900 for a total amount not to exceed $99,900 to continue to provide services associated with hazardous waste management services to County of Monterey RMA - PW (Exhibit 2).
Amendment No. 2 to the Agreement with North State Environmental provides for continued services associated with hazardous waste management services to the County of Monterey RMA - PW. Amendment No. 2 will increase the Agreement by $100,000, for a total amount not to exceed $199,900. An estimated cost for these services was developed in mid-2011 based on the policy and procedure for removing hazardous waste from the roadside at that time. Until November 2011, the practice was for County Road and Bridge Maintenance workers to remove all hazardous/potentially hazardous waste generated by others and left on the side of the road, transport said material to their respective County yards, and dispose of the hazardous waste in containers for pick up by an outside vendor. In November 2011, the policy and procedure was changed whereby employees were no longer to remove any hazardous/potentially hazardous waste that they did not generate, but to report any such non-County generated hazardous /potentially hazardous waste left on the side of the road to North State Environmental for pickup, transport and disposal. The cost of this service far exceeds the historical cost of removal by County forces on which the Agreement's original budget was based. While it is anticipated that the increase of $100,000 will be sufficient to cover the unforeseen volume and nature of dumping activities on the County right-of-way, the actual cost may exceed this amount prior to September 15, 2014, as North State Environmental responds from its base in South San Francisco.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel, and Auditor-Controller, have reviewed and approved Amendment No. 2 as to form and legality, and fiscal terms, respectively.
FINANCING:
Based upon historical usage, funds for services under this Agreement are estimated not to exceed the amount of $199,900. Expenditures under Amendment No. 2 will depend on the actual usage/services provided and will be funded from the Road Fund (Fund 002, Department 3000, Unit 8195, Appropriation Unit RMA012, Account 6835).
