b. Approve and authorize the Director of Health or designee, to sign subcontractor agreements associated with our continued funding agreements for designated programs.
 
Report
RECOMMENDATION:
It is recommended that the Board of Supervisors:
a.      Approve and authorize the Director of Health or designee, to execute on behalf of the County of Monterey standard agreements, and any amendments thereto, for continued funding from local, State, and Federal agencies for designated programs; and
b.      Approve and authorize the Director of Health or designee, to sign subcontractor agreements associated with our continued funding agreements for designated programs.
 
SUMMARY/DISCUSSION:
Continued support and approval by the Board for this recommended action would allow the Director of Health or designee, to continue to submit the approved resolution as authority to sign, submit grant applications and grant agreements to renew funding for those designated programs (Attachment A) without having to request Board approval for each grant application/agreement.  This will significantly reduce the number of board reports submitted for approval annually and will expedite the process.  
 
The Department will continue to present amendments to the final grant agreements that require adjustments to the Final County Budget for changes in appropriations, revenues, and/or positions, to the Board for approval.
 
In addition, the Health Department is requesting that the Board authorize the Director of Health or designee to sign subcontractor agreements associated with our continued funding agreements that are not received in a timely manner by the department. More recently, there have been a number of occurrences where State of California Department funded agreements effective July 1st are not received by the department until many months post start date due to State staffing or budgeting issues. The expectation of the funding agency is that the department will perform services in accordance with the terms, conditions, and budgets outlined within the forthcoming agreement and in some cases, these services are to be performed by community based organizations. Currently, the department does not process subcontractor agreements with community based organizations until the department receives the final approved funding agreement. This process delays implementation of services and likely has an adverse impact on our community such as delaying HIV/AIDS testing, counseling, and treatment services. If request is approved, subcontractor agreements will be executed prior to receipt of final funding agreement in an effort to not negatively impact services provided to the community.  
 
OTHER AGENCY INVOLVEMENT:
County Counsel, Risk Management and the Auditor-Controller agree with the process and will continue to review each grant agreement before the Department signs and submit the agreement to the funding agency.
 
FINANCING:
The majority of appropriations and revenues related to Attachment A have been included in the     Health Department's FY 2013-14 Adopted Budget.   Adjustments in appropriations, revenue, and/or position count will be submitted to the BOS for approval as necessary.  There will be no new General Fund Contribution resulting from this action.
