Approve and authorize the Director of Public Works, Facilities and Parks (PWFP) or designee to execute a non-standard Professional Services Agreement between Provost & Pritchard Engineering Group, Inc. dba Provost & Pritchard Consulting Group and the County of Monterey for design, planning and consulting services and provide construction support services for Parks Water Treatment Systems, with a term beginning August 1, 2026 through July 31, 2029, for an amount not to exceed $500,000;

b. Approve Contract Addendum to Professional Services Agreement for non-standard clauses including Performance Standards, Termination, Indemnification, Confidentiality, County Records, Royalties and Inventions, Format of Deliverables, Compliance with Terms of State or Federal Grants, Conflict of Interest, Disputes, Time is of the Essence, and Construction of Agreement; and

c. Execute up to 2 future amendments to the non-Professional Services Agreement where the amendments do not exceed 10% ($50,000) of the agreement’s amount and do not significantly change the scope of work, subject to County Counsel approval, for an aggregate total contract amount of $550,000.

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and authorize the Director of Public Works, Facilities and Parks (PWFP) or designee to execute a non-Professional Services Agreement between Provost & Pritchard Engineering Group, Inc. dba Provost & Pritchard Consulting Group and the County of Monterey for design, planning and consulting services and provide construction support services for Parks Water Treatment Systems, with a term beginning August 1, 2026 through July 31, 2029, for an amount not to exceed of $500,000;

b. Approve Contract Addendum to Professional Services Agreement for non-standard clauses including Performance Standards, Termination, Indemnification, Confidentiality, County Records, Royalties and Inventions, Format of Deliverables, Compliance with Terms of State or Federal Grants, Conflict of Interest, Disputes, Time is of the Essence, and Construction of Agreement; and

c.  Execute up to 2 future amendments to the non-Professional Services Agreement where the amendments do not exceed ten percent 10% ($50,000) of the agreement’s amount and do not significantly change the scope of work, subject to County Counsel approval, for an aggregate total contract amount of $550,000.

 

SUMMARY:

The Department of Public Works, Facilities and Parks (PWFP) requests approval to contract with Provost & Pritchard Engineering Group, Inc. dba Provost & Pritchard Consulting Group (Provost) to complete a turbidity evaluation of the surface water treatment plant at Lake San Antonio, South Shore and provide construction support services during construction.  The State Water Resources Control Board (Waterboard) issued an updated Notice of Violation to the Lake San Antonio South Shore Water Treatment System on January 6, 2026.  While work has been completed to reduce the filtered water turbidity, it has not been successful in reducing it below the Maximum Contaminant Level set by the State.  This updated Notice of Violation requires County of Monterey PWFP to bring the system into full compliance by June 30, 2026.  While the Waterboard has agreed to issue extensions in the past, time is of the essence to avoid significant financial penalties, potentially resulting in the temporary closure of Lake San Antonio South Shore engaging Provost is necessary for accomplishing this effort.

 

DISCUSSION:

Provost was established in 1968 with a strong tradition of engineering and consulting excellence.  Provost has offices in California and Idaho and specializes in civil and agricultural engineering, environmental and land use planning, hydrogeology and geology, surveying, and construction management services in the areas of water resources, municipal infrastructure, agriculture, site development, and environmental compliance.

 

Provost services will include a turbidity evaluation of the surface water treatment plant at Lake San Antonio, South Shore, provide plant evaluation, plant condition assessment, recommend process modifications and construction assistance.

 

Provost is one of the few consultant groups in California that specialize in complex Surface Water Treatment Systems.  Given the complexity and variable nature of the water chemistry of Lake San Antonio water, a consultant with technical expertise specializing in Surface Water Treatment is essential.  The State Water Resources Control Board (Waterboard) issued an updated Notice of Violation to the Lake San Antonio South Shore Water Treatment System on January 6, 2026.  The Notice of Violation specifically requires water turbidity to be reduced below the Maximum Contaminant Level by June 30, 2026.  The Waterboard will provide an extension, if the County is able to show progress.  Selecting Provost for consultancy and design work will demonstrate measurable progress to the State while long term plans are developed.

 

Provost submitted a Contract Addendum to the County’s Professional Services Agreement for non-standard clauses for Performance Standards, Termination, Indemnification, Confidentiality, County Records, Royalties and Inventions, Format of Deliverables, Compliance with Terms of State or Federal Grants, Conflict of Interest, Disputes, Time is of the Essence, and Construction of Agreement.

 

Staff requests the Board of Supervisors approve and authorize the Director of Public Works, Facilities and Parks or designee to execute the proposed non-standard Professional Services Agreement and Addendum (Attachment A) with Provost for a term of August 1, 2026 to July 31, 2029, and to execute up to two future amendments for an aggregate not to exceed total of $550,000.

 

OTHER AGENCY INVOLVEMENT:

The Office of County Counsel, Risk Manager and Auditor-Controller’s Office reviewed and approved the proposed non-standard Professional Services Agreement and Addendum as to form and fiscal provisions, respectively.

 

FINANCING:

There is sufficient funding in the Fiscal Year 2026-2027 Adopted Budget, for General Fund 1001, Park Operations Appropriation Unit PFP108.  Future costs will be included in the respective fiscal year recommended budgets.

 

BOARD OF SUPERVISORS STRATEGIC PLAN GOALS:

The Department of PWFP-Parks and Lakes Division is responsible for maintaining County Parks infrastructure.  Upgrading water treatment plants at Lake San Antonio maintains the infrastructure and ensures a safe and healthy environment for the public to enjoy, supporting community well-being, enhancing quality of life, and contributing to safe and resilient communities.
