Consider adopting a resolution to:
a. Approve a Memorandum of Understanding (MOU) retroactive to August 29, 2023 between the County of Monterey, the Pajaro County Sanitation District, and the Monterey County Water Resources Agency to support the Pajaro Force Main Relocation project;
b. Authorize the Director of Public Works Facilities and Parks (PWFP) to sign the MOU; and
c. Authorize and direct the Auditor-Controller to amend the Fiscal Year (FY) 2023-24 Adopted Budget for the Pajaro County Sanitation District, Fund 151, Appropriation Unit PFP047, to increase appropriations by $1,000,000, where the financing source is California Disaster Assistance Act deferred revenue (151-2875) (4/5ths vote required).

RECOMMENDATION:
It is recommended that the Board of Supervisors adopt a resolution to:
a. Approve a Memorandum of Understanding (MOU) retroactive to August 29, 2023 between the County of Monterey, the Pajaro County Sanitation District, and the Monterey County Water Resources Agency to support the Pajaro Force Main Relocation project;
b. Authorize the Director of Public Works Facilities and Parks (PWFP) to sign the MOU; and
c. SUMMARY/DISCUSSION:
The Monterey County Water Resources Agency (“Agency”) is the “non-federal sponsor” of the United States Army Corps of Engineers (“USACE”) Pajaro River Levee Federal Project Left Bank (“Levee”) under Public Law 84-99 (“PL 84-99”) and is charged with the operations and maintenance of said levee system within Monterey County. Due to severe weather events in 2023, the Levee sustained erosion at the Caltrans State Route 1 bridge location (“Site 2”). The Pajaro County Sanitation District’s (“District”) sewer force main was damaged and was temporarily repaired. A relocation of the sewer force main is necessary in order for the USACE to fix the eroded levee at Site 2. An existing irrigation line casing adjacent to the Levee was also damaged. The casing travels under the State Route 1 bridge and needs replacement in order to provide future protection of the Levee.
The County, as the service provider for the District, obtained all necessary approvals and entered into contracts for the relocation of a portion of the sewer force main, to an alignment outside of USACE’s planned levee repair and outside of the Caltrans bridge abutment slope. The County’s contracts also include the reconstruction of the additional steel casing for protection of the Levee. The Agency shall reimburse the County for the construction and the pro-rata share of the design and construction management of the casing project. Both the County and the Agency is tracking the cost of the projects and will submit them to the California Office of Emergency Services (CalOES) and Federal Emergency Management Agency (FEMA), coordinating with the County Department of Emergency Management (DEM).
OTHER AGENCY INVOLVEMENT:
PWFP has collaborated with WRA staff in drafting the MOU and developing terms for said MOU. The Office of the County Counsel has reviewed and approved the MOU as to form.
FINANCING:
The cost estimate for the overall project is approximately $1.0 million. MCWRA will pay the cost of its share, which is yet to be determined. This is being cash-flowed by the California Disaster Assistance Act (CDAA) Cash Advance from the State for PCSD. County will seek maximum federal participation in funding this project, and as such, claims will be submitted to both the Federal Emergency Management Agency (FEMA) and California Office of Emergency Services (Cal OES) for reimbursement.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The proposed project will relocate the sewer force main and irrigation pipeline casing, allowing USACE to repair the damaged levee at this location. The recommended action complies with the Board of Supervisors’ Strategic Initiatives for Infrastructure and Public Safety.
