Report

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Authorize the Director of the Information Technology Department or his designee to execute a non-standard agreement with CommScope Technologies, LLC, dba Comsearch, for Federal Communications Commission license management services in an amount not to exceed $20,750, for a term of October 10, 2017 through October 9, 2022; and

 

b. Accept non-standard contract provisions as recommended by the Director of Information Technology.

 

SUMMARY/DISCUSSION:

This contract/service agreement has two main functions: protecting the Federal Communications Commission (FCC) licensing that supports Monterey County microwave systems, and the land mobile radio and other wireless frequencies that operate within Monterey County.  Comsearch will provide reports covering all fixed microwave and land mobile radio call signs; application filing upon request; advice on license issues, waivers, and rule changes; and frequency protection services.  Comsearch will track FCC applications and public notices to ensure non-interference with County frequencies and will report to the County regarding its interference analysis.

 

These services are crucial to ensure uninterrupted service delivery to all 28 Monterey County public safety agencies who are members of the NGEN Radio System, as well as the critical infrastructure supporting network service delivery (Voice over IP, enterprise email, web applications, etc.) to all County employees.

 

OTHER AGENCY INVOLVEMENT:

County Counsel cannot approve the agreement based on the following non-standard provisions:  non-standard evidence of insurance coverage provisions; non-standard notification of insurance cancellation provisions; non-standard inventions and royalty’s provisions; deletion of compliance with federal and state grants provisions; limitations on the amount and type of Comsearch’s liability to the County, in the event of breach of contract.  Risk does not approve non-standard insurance provisions.

 

FINANCING:

The cost for this agreement is $20,750 of which $4,150 is included in the Fiscal Year 2017-18 Adopted Budget for the Information Technology Department, ITD 1930, Unit 8436, Appropriations Unit INF002. Amounts for remaining years of the agreement will be included in those budgets as appropriate. There is no impact to the General Fund.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

This agreement supports the protection and long-term sustainability of the County’s wireless (microwave) backbone infrastructure which provides enterprise data and voice services to all Monterey County employees as well as essential emergency communications that protect public safety. Loss of a microwave license, or interference caused by an outside organization could disable, or negatively impact the delivery of these services. This agreement will ensure they are protected and viable, and that the County is notified in the event of any potential impact.
