RECOMMENDATION:
1. Ratify and Approve the Action of the CAO to Review and Terminate the status of the Local Emergency near the Moro Cojo Slough.
2. Approve a Proclamation Terminating a Local Emergency near the Moro Cojo Slough.
SUMMARY:
On November 3, 2015, the Board adopted Resolution No. 15-101, which proclaimed an emergency relating to a failure in the flap gate and culvert system underneath Moss Landing Road in the Moro Cojo Slough.
Approval of the emergency proclamation allowed for temporary repairs to be made to the culvert system and for these temporary repairs to be maintained while a permanent solution is designed.
DISCUSSION:
Those temporary repairs have been made and a separate MOU between the County/RMA and the Monterey County Water Resources Agency has been negotiated to develop and implement a permanent solution. That MOU will be separately presented to the Board for action. The County Administrative Officer, in the absence/unavailability of the Board of Supervisor to take action, in consideration of the actions taken by the County and the MCWRA to address the issues that gave rise to the emergency proclamation, and pursuant to the reviewing requirements of Government Code section 8630, declared termination of the emergency at Moro Cojo Slough on January 14, 2016.
Accordingly, it is recommended that the Board ratify the action of the County Administrative Officer and formally terminate the proclamation of emergency by adopting the attached Resolution.
OTHER AGENCY INVOLVEMENT:
The mitigation efforts of the foregoing conditions affecting the Moro Cojo Slough include Monterey County Resource Management Agency; Planning Department and Monterey County Public Works Department, Water Resources Agency, Monterey County Health Department - Environmental Health Division, the California Coastal Commission (original jurisdiction for permit authority), Moss Landing Harbor District, US Army Corp of Engineers, US Fish and Wildlife Services, Water Board, and State Fish and Wildlife.
FINANCING:
This proclamation terminating a local emergency will not impact the General Fund. Actions taken pursuant to the MOU referenced above will result in costs and are discussed in the related Board Report.
