Title: a. RECOMMENDATIONS:
It is recommended that the Board of Supervisors:
a.   Award a contract to AAA Fence Company, Inc., the lowest responsible and responsive bidder, for the 1410 Natividad Rd, Salinas, California, Upgrade Security Fencing, Project No. 8529, Bid Package No. 10348, in the total amount of $146,825;
b.   Approve the Performance and Payment Bonds executed and provided by AAA Fence Company, Inc.;
c.   Authorize a contingency (not to exceed 10 percent of the contract amount) to provide funding for approved contract change orders; and
d.   Authorize the Director of Public Works to execute the contract and, subject to the terms of the Public Contract Code, approve contract change orders where total change orders do not exceed 10 percent of the original contract amount, and do not significantly alter the scope of work.
 
SUMMARY/DISCUSSION:
On February 28, 2012, the Board approved the Plans and Specifications for the 1410 Natividad Rd, Salinas, California, Upgrade Security Fencing, Project No. 8529, Bid Package No. 10348 (Project).  The Project was advertised and a single bid was opened on March 29, 2012.  The bidder, AAA Fence Company, Inc., with the base bid plus additive alternatives #1 and #2B for the bid amount of $214,729, was determined to be responsive and responsible.  The Engineer's estimate for construction of the base bid and additive alternates #1 and #2B is $241,700.  The bid documents required bidders to submit pricing for multiple Additive Alternates.  The Office of the Sheriff Custody Operations Bureau and Department of Public Works reviewed the bids and selected the combination of additive alternates that provide the best value to the County.  The combination of alternatives selected is the base bid plus additive alternates #1 and #2A that combined total $146,825.  The Project is scheduled to begin in July 2012, with completion by September 2012.
 
Work to be done for the base bid elements consists of, in general, repair and replacement of existing perimeter fencing materials and installation of new barbed wire and other materials.  Scope for additive alternates selected for this award include placement of those same materials in zones considered less vulnerable.
 
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and Contracts/Purchasing attended the bid opening and reviewed the low bid for conformance with applicable regulations.  The Office of the County Counsel, Auditor-Controller, and Risk Management, have reviewed and approved the contract documents as to form and legality, fiscal terms, and insurance provisions, respectively.
 
FINANCING:
There is no impact to the General Fund.  This Project has been fully funded by prior Board actions.  The total Project budget is $350,000.  This amount is sufficient to cover estimated project costs for design, engineering, and the fencing upgrades selected.  Total costs for the Project to date are $61,671.  Any remaining funds after the Project is complete will be transferred back to Fund 402 to be redirected to other projects.
