b. Authorize the Contracts & Purchasing Officer or their designee to execute Amendment No. 3 to Professional Services Agreement No. A-15826 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or increase the approved Agreement amount.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 3 to Professional Services Agreement No. A-15826, Multi-Year Agreement #3200*6415, with Biggs Cardosa Associates, Inc. to continue to provide construction management services for the Hartnell Road Bridge Replacement Project, County Bridge No. 209, Request for Proposals #10804, to increase the not to exceed amount by $75,567 for a total amount not to exceed $955,739 with no extension to the term from June 15, 2022 to June 14, 2025, with the option to extend the term for two additional 1-year period(s); and

SUMMARY/DISCUSSION:
The County of Monterey Department of Public Works, Facilities and Parks (PWFP) is replacing the existing two-lane Hartnell Road Bridge (County Bridge No. 209) over Alisal Creek in Monterey County, California, with a wider bridge, Hartnell Road Bridge Replacement (Project), that meets current American Association of State Highway and Transportation Officials (AASHTO) requirements. The Project also widens the roadway approaches for approximately 370 to 470 feet on the north and south ends of the bridge to conform to the replacement bridge width and profile. After construction, both the bridge and roadway approaches will contain two 12-foot lanes and two 8-foot shoulders which are required to meet current AASHTO minimum speed standards.
On June 7, 2022, the Board of Supervisors approved Professional Services Agreement (PSA) No. A-15826 with Biggs Cardosa Associates, Inc. (BCA) to provide construction management services for the Project for a term through June 14, 2025.
Damage from the 2023 winter storms required emergency channel protection, coordination and management of permit extensions, permit updates, and the design of permanent repair improvements. Construction management services were required for both the emergency measures and the permanent repairs. To provide these services, including project close-out, the previously projected completion date was extended. Amendment No. 3 will provide additional construction management services for the one-year revegetation maintenance and monitoring period, which is required for the completion and close-out of the Project.
PWFP staff recommends that the Monterey County Board of Supervisors approve Amendment No. 3 (Attachment A) to the PSA to allow BCA to continue construction management services for the Project. Amendment No. 3 will increase the not to exceed amount of $880,172 by $75,567 for a total amount not to exceed $955,739 with no extension to the term ending on June 14, 2025.
Attachments B, C, D, E, F and G, provided for reference, respectively, include Amendment No. 1 and Amendment No. 2 to PSA No. A-15826, PSA No. A-15826, Project budget, Project location map and a summary of the PSA and its annual expenditures and balance to date.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and the Auditor-Controller’s Office have reviewed and approved Amendment No. 3 as to form, and fiscal provisions, respectively.
FINANCING:
The total estimated cost of the Project including design engineering, environmental, right-of-way, and construction is $6,548,223. The Project is largely funded by the Federal Highway Administration Highway Bridge Replacement and Rehabilitation Program in the amount of $4,797,434. The Federal funds require an 11.47% local match that will be provided by the State Toll Credits fund in the amount of $621,558. Local Measure X funds in the amount of $1,129,231 will also be provided. See Attachment E for further details on the Project budget. There are sufficient appropriations in the adopted fiscal year 2024-25 Road Fund 002, Appropriation Unit PFP004 budget to finance Amendment No. 3 for the construction phase of the Project.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The recommended action supports the Board of Supervisors’ Strategic Initiatives for Infrastructure and Public Safety. The Project consists of replacing the existing Hartnell Road Bridge that is structurally deficient and functionally obsolete with a new two-lane bridge that meets current Federal standards, including geometric and seismic standards.
