RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Authorize the Director of Health or the Assistant Director of Health to enter into an agreement not to exceed the amount of  $935,000 with the Community Foundation for Monterey County to implement components of a Farmworker Resource Center Program for the term of July 1, 2023 through May 15, 2024;
b. Accept the recommendation of the Director of Health or the Assistant Director of Health to accept nonstandard indemnification provision of the Agreement;
c. Authorize the Director of Health or Assistant Director of Health to execute Data Use Agreements, for the term July 1, 2023 through May 15, 2024, between the County of Monterey and Farmworker Resource Center partners (Community Foundation for Monterey County, Center for Community Advocacy, Centro Binacional para el Desarrollo Indígena Oaxaqueño, and Mujeres en Acción)
; and
d. Approve and authorize the Director of Health or Assistant Director of Health to approve up to three (3) future amendments to this agreement where the amendments

SUMMARY/DISCUSSION:
On September 22, 2021, Governor Gavin Newsom signed AB 941 (Bennett, Chapter 203) into law, establishing the Farmworker Resource Center Grant Program. AB 941 provides California counties the opportunity for funding to help create farmworker resource centers to assist farmworkers in navigating public agencies, receiving information regarding wage and hour laws, health, and safety laws, resolving workplace disputes, and pursuing other legal rights. AB 941 also called for the establishment of a Farmworker Resource Center Workgroup consisting of specified representatives to work with the department on the development of evaluation criteria for Farmworker Resource Center grant applications and awards. Farmworker Resource Centers can also provide resources and information regarding programs related to labor and employment rights, education, housing, utilities, immigration, and health and human services, including, but not limited to, food security, mental health, and childcare assistance. County of Monterey Health Department (MCHD) applied and received funding for a total award amount of $834,000 by the Department of Community Services and Development with a match by the County of $208,250 to establish a Farmworker Resource Center Program to increase information and access to services for farmworkers and their families and reduce challenges faced by farmworkers and the agricultural industry around Monterey County, California, from February 15, 2023, to May 15, 2024.

The successful application by MCHD focuses on a strength-based approach and a workplan that continues farmworker-specific approaches of community outreach, engagement, and systems navigation around the social determinants of health and as started by the Virus Integrated Distribution of Aid (VIDA) project. The grant funding has a small amount allotted to cover MCHD oversight and project management staffing cost (covered by the matching funds), and the majority of granted funds along with a portion of the matching funds will be subcontracted to Community Foundation for Monterey County to engage at least three VIDA Community Based Organizations (CBOs) and at least six of their Community Health Workers to implement the grant’s goals, objectives, and strategies and provide operating supports, such as training and travel, for the grant period.

County of Monterey Health Department, Planning, Evaluation and Policy Unit has been working diligently to improve the consistency of data collection methods to include documentation and implementation of data sharing and use agreements for various projects in which the County of Monterey Health Department is engaged in project or program evaluation activities. The Farmworker Resource Center program, in its’ infantile stages, has been working closely with program partners to develop the scope of work for activities. Thus, along with an agreement for CFMC to receive funds for the work, each partner involved will use a data sharing and use agreement. This data sharing and use agreement between MCHD and participating partners sets forth obligations related to safeguarding of data collected by CBOs from July 1, 2023, to May 15, 2024. Per requirements of the additional language in the data sharing and use agreements, MCHD will limit direct access to the raw data collected to only the approved data users and data will be saved on a secured county drive which is password and user protected. Once received, the data set are analyzed for various conditions that may not be reported on in other readily available reports or may be age adjusted, for which individual de-identified data are required. The collection of data will ensure qualitative data regarding program progress, successes and challenges are collected for project or program evaluation purposes. All additional data collected will be used to assess the efficacy of strategies including the provision of information and resources as it relates to overall Farmworker Resource Center program goals and objectives.

This work supports County of Monterey Health Department 2018-2022 Strategic Plan Goals: 1. Empower the community to improve health; 2. Enhance community health and safety through prevention; 3. Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services; and 4. Engage HD workforce and improve operational functions to meet current and developing population health needs.  It also supports one of the ten essential public health services, specifically: 9. Evaluate effectiveness, accessibility, and quality of personal and population-based health services.

OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and Auditor-Controller have reviewed and approved this Agreement as to form and fiscal provisions, respectively.

FINANCING:
There is no impact to the General Fund resulting from the approval of this action.  There are sufficient appropriations in the Health Department’s (8438-HEA014) FY 2023-24 Adopted Budget.
