a. Approve and authorize the Public Defender or designee to execute a Standard Agreement with Sun Street Centers for $2,116,303 to provide Board of State and Community Corrections Proposition 47 Cohort IV grant funded substance use disorder treatment services in Monterey County, with a term of July 1, 2025, through June 30, 2028, including non-standard payment provisions; and
b. Authorize and direct the Auditor Controller to issue a cash flow advance to Sun Street Centers in the amount of $122,655 upon contract execution to expedite provision of Proposition 47 Cohort IV substance use disorder treatment services to eligible recipients; and
c. Authorize the Public Defender or designee to execute up to five (5) future amendments to this Agreement, where the amendments do not alter the not-to-exceed of $2,116,303 and do not significantly alter the scope of work.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Public Defender or designee to execute a Standard Agreement with Sun Street Centers for $2,116,303 to provide Board of State and Community Corrections Proposition 47 Cohort IV grant funded substance use disorder treatment services in Monterey County, with a term of July 1, 2025, through June 30, 2028, including non-standard payment provisions; and

SUMMARY/DISCUSSION:
On November 12, 2024, per Board Order No. A-17152, the County of Monterey Board of Supervisors authorized the Office of the Public Defender to accept an $8,000,000 Proposition 47 Cohort IV Grant (Prop. 47) award from the Board of State and Community Corrections (BSCC) and authorized execution of the associated grant agreement to fund mental health services, substance use disorder services, housing related assistance, community-based supportive services, and additional prevention/early intervention diversion services to Prop. 47 eligible adults and juveniles.
Sun Street Centers is a nonprofit, Medi-Cal certified organization dedicated to preventing and treating substance use disorders in Monterey County. This agreement addresses multiple funding gaps related to substance use disorder treatment for the Prop. 47 population and ensures provision of necessary treatment and diversion for this population.
Sobering Center: Funding will be used to increase operational capabilities of the Salinas Sobering Center, shifting the Center from part-time to 24/7 operations. The Sobering Center provides an intervention program that administers to a participant’s level of intoxication from alcohol and other drugs in a supportive short-stay environment overseen by qualified on-site staff. The services provided by the Sobering Center save law enforcement time and money, contribute to public health and community safety, and provide an avenue to connect receptive individuals with additional substance use treatment and/or supportive services and resources.
Treatment Services: This agreement will allow Sun Street Centers to provide outpatient treatment, residential treatment, and sober living accommodations to Prop. 47 eligible participants, ensuring participants have access to appropriate level of care services. Additionally, this agreement will allow for the provision of in-custody assessments, enabling participants to have more immediate access to services upon release from custody. Lastly, to ensure seamless access to care, this agreement will facilitate transportation from the Monterey County Jail to residential treatment for participants exiting custody.
Outreach and Program Coordinator: This agreement will allow for the provision of an Outreach and Program Coordinator who will increase Prop. 47 participant access to substance use disorder treatment and services, perform case management to maximize participant success, expand Sobering Center capabilities, and optimize implementation of Prop. 47 programming.
OTHER AGENCY INVOLVEMENT:
County Counsel has reviewed and approved as to form. The Auditor-Controller’s Office has reviewed and does not agree with the nonstandard payment provisions.
FINANCING:
There will be no impact to the General Fund from this action. This Agreement is funded by Proposition 47 Cohort IV Grant funding. The Proposition 47 Cohort IV Grant does not require matching funds.
