a. Approve Amendment No. 4 to Professional Services Agreement No. A-11906 with TRC Engineers, Inc. to include final design for Phase 2 and support services during the bid and construction for Phase 3 of the Castroville Railroad Crossing Bicycle/Pedestrian Path (RFQ/RFP #10197), Project No. 862265, Federal Aid Project No. HP21L-5944 (097) (formerly Federal Aid Project No. STPLHSR-5944 (058)), in the amount of $568,044 for a total amount not to exceed $964,791, and extend the term through December 28, 2015;
b. Authorize the Contracts/Purchasing Officer to extend the term of Professional Services Agreement No. A-11906 with TRC Engineers, Inc. for the Castroville Railroad Crossing Bicycle/Pedestrian Path (RFQ/RFP #10197) through December 28, 2015; and
c. Authorize the Contracts/Purchasing Officer to execute Amendment No. 4 to Professional Services Agreement No. A-11906 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or change the approved Agreement amount.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 4 to Professional Services Agreement No. A-11906 with TRC Engineers, Inc. to include final design for Phase 2 and support services during the bid and construction for Phase 3 of the Castroville Railroad Crossing Bicycle/Pedestrian Path (RFQ/RFP #10197), Project No. 862265, Federal Aid Project No. HP21L-5944 (097) (formerly Federal Aid Project No. STPLHSR-5944 (058)), in the amount of $568,044 for a total amount not to exceed $964,791, and extend the term through December 28, 2015;
b. Authorize the Contracts/Purchasing Officer to extend the term of Professional Services Agreement No. A-11906 with TRC Engineers, Inc. for the Castroville Railroad Crossing Bicycle/Pedestrian Path (RFQ/RFP #10197) through December 28, 2015; and
c. Authorize the Contracts/Purchasing Officer to execute Amendment No. 4 to Professional Services Agreement No. A-11906 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or change the approved Agreement amount.
SUMMARY/DISCUSSION:
On December 14, 2010, the Board of Supervisors approved Professional Services Agreement (PSA) No. A-11906 with TRC Engineers, Inc. in the amount of $329,510 to provide preliminary engineering and environmental services for Phase 1 of the Castroville Railroad Crossing Bicycle/Pedestrian Path (RFQ/RFP #10197) for the initial term of one (1) year from execution of the PSA, December 28, 2010, through December 28, 2011including the option to extend the PSA for two (2) additional one (1) year periods in accordance with the terms and conditions of the PSA. This initial phase of work covered the project limits between Axtell Street and Castroville Boulevard, within the vicinity of Benson Road and Collins Road in the community of Castroville.
On December 13, 2011, the Board of Supervisors approved Amendment No. 1 to PSA No. A-11906 in the amount of $67,237 for a total amount not to exceed $396,747 to provide additional preliminary engineering and environmental services associated with the extension in the project limits for Phase 1 of the Castroville Railroad Crossing Bicycle/Pedestrian Path and extend the term through December 28, 2012.
On December 7, 2012, the Contracts/Purchasing Officer executed Amendment No. 2 to PSA No. A-11906 to extend the term of the PSA through December 28, 2013.
On June 24, 2013, the Contracts/Purchasing Officer executed Amendment No. 3 to PSA No. A-11906 to update TRC Engineers, Inc.'s personnel classifications in the rate schedule with no increase to the overall budget for Phase 1 of the Castroville Railroad Crossing Bicycle/Pedestrian Path.
Amendment No. 4 provides for inclusion of Phase 2, Final Design Basic Tasks, and Phase 3, Support services for the bid and construction Phase Tasks, for the Castroville Railroad Crossing Bicycle/Pedestrian Path. Amendment No. 4 will increase the PSA by $568,044, for a total amount not to exceed $964,791, and extend the term through December 28, 2015.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and Auditor-Controller have reviewed and approved Amendment No. 4 as to form and legality, and fiscal provisions, respectively. In accordance with the terms and conditions of RFQ/RFP #10197 and the PSA, the Contracts/Purchasing Officer does not have the authority to further extend the PSA beyond December 28, 2013, the PSA's current expiration date. RMA - Public Works requests that the Board of Supervisors approve Amendment No. 4 to allow for a PSA term extension through December 28, 2015.
FINANCING:
There is no impact to the General Fund. The estimated total cost of the Project, including engineering, environmental, right-of-way and construction, is $8,747,078. Funding from a variety of Federal, State and local sources has been authorized for Phase 2 and Phase 3 of the Project. Sufficient funds are available in the RMA - Public Works Road Fund (Fund 002, Department 300, Unit 8195, Appropriation Unit RMA012) to finance Amendment No. 4. Federal, State and local grants will be pursued for the $1,517,068 amount that remains unfunded from the estimated total cost of the Project.
