RECOMMENDATIONS:
It is recommended that the Board of Supervisors:
a. Approve an Amendment to the Real Property Purchase Agreement, No. A-11403, and a License Agreement with Jonathan C. Wooster and Margaret Jane Wooster, Trustees of the 1993 Wooster Revocable Trust U/D/T dated 12/1/93 as to the fee estate, in the amount of $1,000 for the License Agreement and $24,000 to remove and relocate the existing steel fence for the construction of the Lonoak Road Bridge at Lewis Creek, County Bridge No. 402, State Bridge No. 44C-0158, Federal Aid Project No. BRLOZB-5944(035), Project No. 09-220565 east of King City; and
 
b. Authorize the Director of Public Works to execute the Amendment to Real Property Purchase Agreement, No. A-11403, and License Agreement (Jonathan C. Wooster APN No. 419-141-015 in Monterey County) including the Certificate of Acceptance and Consent to Recordation on behalf of the County.
 
SUMMARY:
Approval of the Amendment to the Real Property Purchase Agreement, No. A-11403, (Amendment) with Jonathan C. Wooster and Margaret Jane Wooster will provide for the removal and the relocation of the existing welded steel pipe/pole fence (steel fence).  This relocation will provide a 12-foot wide field access road between the steel fence and the bridge roadway approach fill.  Approval of the License Agreement will allow the use of the 12-foot wide access road by Resource Management Agency - Public Works (RMA-PW) maintenance personnel.
 
DISCUSSION:
On April 14, 2009, the Board approved the Real Property Purchase Agreement, No. A-11403 with Jonathan C. Wooster and Margaret Jane Wooster, Trustees of the 1993 Wooster Revocable Trust U/D/T dated 12/1/93 as to the fee estate, for the Lonoak Road Bridge at Lewis Creek, County Bridge No. 402, State Bridge No. 44C-0158, Federal Aid Project No. BRLOZB-5944(035), Project No. 09-220565 (Project).  
 
The Project consisted of replacing the existing bridge with a new bridge at Lewis Creek.  The Lonoak Road Bridge is along Lonoak Road and spans over Lewis Creek.  The bridge is located 13.5 miles east of King City, and 0.5 mile west of State Highway 25.  The bridge serves the rural agricultural area along Lonoak Road and provides travel route between Hwy 101 in King City east to State Highway 25.  
 
The new bridge has been constructed and consists of a two lane concrete box girder bridge that is 34.4 feet wide and 152 feet long with two spans.  The construction of the new bridge eliminated the existing field access at the southeast corner of the bridge.  Approval of the Amendment will provide compensation to Jonathan C. Wooster and Margaret Jane Wooster to reconstruct the existing steel fence away from the roadway approach fill.  This move will provide the Woosters a field access road similar to what they had prior to the bridge construction.
 
Approval of the License Agreement will allow the RMA-PW to utilize the 12-foot field access road for inspection, maintenance, and repair of Lonoak Road Bridge.
 
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel has reviewed and approved the Amendment and the License Agreement as to form and legality.  The Project is conducted by RMA-PW with oversight by the Caltrans Office of Local Assistance.
 
FINANCING:
There is no financial impact to the General Fund.  There are sufficient appropriations in the Road Fund (Fund 002, Unit 8195) to fund the $25,000 cost of the Amendment and the License Agreement.  However, these costs were not identified in the FY 2012-13 Adopted Budget.  RMA-PW will be returning to the Board shortly with a modified work plan that will reflect theses costs as well as other changes that have occurred since the FY 2012-13 Budget was prepared.
