Title: a. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and authorize County Counsel/Risk Management to execute a Professional Services Agreement (“PSA”) with Kennedy/Jenks Consultants, Inc. for gauging, monitoring and reporting groundwater and lake conditions at the Lake San Antonio Resort/Marina Site and client representation with the Regional Water Quality Control Board, retroactive to June 30, 2025, through July 1, 2028 (3-year term), in the amount not to exceed $200,000; and

b.  Authorize County Counsel/Risk Management to execute up to two future amendments to this agreement where the amendments do not significantly change the scope of work and do not cause an increase of more than 10% ($20,000) of the original contract amount and do not increase the total contract amount above $220,000. 

 

SUMMARY/DISCUSSION:

Kennedy/Jenks Consultants, Inc. provides environmental consulting and oversight of remediation activities at the Lake San Antonio Resort/Marina Site, as required by the California State Water Resources Control Board and the Regional Water Quality Control Board (“Water Boards”). The County initially entered into an agreement with Kennedy/Jenks in 2016 to address a historical fuel spill at the site

 

The most recent work has involved operation of a “bioventing system” required by the Water Boards, designed to reduce the contaminant mass in the soil and groundwater in and around the affected area. Kennedy/Jenks Consultants, Inc. previously requested authority to close out the monitoring phase; however, the Regional Water Quality Control Board determined that additional monitoring and reporting are necessary to ensure that remediation is complete and conditions remain protective of water quality.

 

Under this new agreement, Kennedy/Jenks will continue to provide environmental consulting services, including semiannual groundwater and surface water monitoring and sampling, well resurveying, management and disposal of investigation-derived waste, data migration into a centralized database and Power BI visualization platform, and evaluation of groundwater and surface water data. The firm will also prepare and submit required reports to the Regional Board and coordinate with County staff and regulatory agencies to determine any future actions required.

 

The total contract amount shall not exceed $200,000 over the three-year term, from June 30, 2025, through July 1, 2028. The scope and budget are based on Regional Board requirements for continued monitoring, as detailed in Exhibit A to the Professional Services Agreement. All written reports will be submitted to David J. Bolton, Risk Manager, in accordance with the schedule provided in Exhibit A.

 

OTHER AGENCY INVOLVEMENT/COMMITTEE ACTIONS: 

County Counsel has reviewed and approved as to form; Contracts/Purchasing and the Office of the Auditor-Controller as to fiscal terms; and Risk Management for insurance and indemnity provisions.

 

FINANCING:

Services rendered under this agreement will be paid through the Internal Services Fund, with no impact to the General Fund.
