RECOMMENDATION:

It is recommended that the Board of Supervisors:

Approve and authorize the County of Monterey Treasurer-Tax Collector to execute the Assignment and Assumption Agreement between Ontario Business Systems, LLC and Columbia Ultimate Business Systems, LLC effective January 12, 2024, assigning County Agreement No. A-15436 and Agreement No. A-16519 from Ontario Business Systems, LLC to Columbia Ultimate Business Systems, LLC.

 

SUMMARY/DISCUSSION:

The County of Monterey Treasurer-Tax Collector’s Revenue Division performs collection services of court-ordered debt. The Revenue Plus Collector System is the Revenue Division’s case management system for court-ordered debt collection and accounting.

 

On July 13, 2021, the Board of Supervisors (Board) approved Agreement No. A-15436 by and through the Treasurer-Tax Collector, and Ontario Systems, LLC to provide software licenses, software maintenance support, and professional services for the Revenue Plus Collector System retroactive to July 1, 2021 through June 30, 2024.

 

On July 26, 2023, the Board of Supervisors approved Agreement No. A-16519 by and through the Treasurer-Tax Collector, and Ontario Systems, LLC to provide correspondence services, including printing and mailing of letters to customers, demographic searches, and electronic address confirmation via the Revenue Plus Collector System retroactive to July 1, 2023 through June 30, 2024.

 

Assignor Ontario Business Systems, LLC and Assignee Columbia Ultimate Business Systems, LLC entered into an Assignment and Assumption Agreement, effective January 12, 2024. Ontario Systems, LLC agreed to assign Agreement No. A-15436 and Agreement No. A-16519 to Columbia Ultimate Business Systems, LLC.

 

This Assignment and Assumption is made to confirm the County’s acknowledgement and consent of Assignor intentions to assign it rights, title, and interest in and to, and all of its obligations under the aforementioned Agreement to Assignee, and Assignee accepts such assignment and to assume such obligations. Some delays to processing this Assignment and Assumption Agreement were encountered due to multiple iterations of reviewing and modifying legal documentation with vendor counsel.

 

OTHER AGENCY INVOLVEMENT:

The office of County Counsel has reviewed and approved the proposed Assignment and Assumption Agreement as to legal form. The Auditor-Controller has also reviewed and approved the proposed Assignment and Assumption Agreement as to fiscal provisions.

 

FINANCING:

Approval of the recommended Agreement has no impact on the County’s General Fund as there is no direct cost and court-ordered collection costs are eligible for recovery through the State of California Comprehensive Collection Program per PC 1463.007. Adequate funding was included in the adopted budget for FY2023-24 expenditures. 

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The request to assign and assume this agreement supports the County’s Administration initiative because it allows the department to operate in an efficient and cost-effective manner by having reliable case management software for the collection of court-ordered debt.
