RECOMMENDATION:
It is recommended that the Board of Supervisors approve and authorize the Director of Public Works, Facilities and Parks (PWFP) to execute Amendment No. 1 to Agreement No. A-17868 between the County of Monterey (County) and Avila Brothers Inc., doing business as Avila Construction Company for the 65650 Bradley Street, Bradley-New Bradley Library and Resiliency Center Project No. 8821, Bid Package No. 10966 (Project), to update contract schedule, with no increase to the total contract amount.
SUMMARY:
Staff is recommending that the Board of Supervisors (Board) approve and authorize the Director of Public Works, Facilities and Parks (PWFP) to execute Amendment No. 1 to Agreement No. 17868 (sometimes referred to as “construction contract” or “contract”) between the County and Avila Brothers Inc., doing business as (dba) Avila Construction Company. Proposed Amendment No. 1 to the construction contract between the County and Avila Construction Company will update the contract schedule from calendar days to working days to align with the requirements provided in Addendum No. 3, Pre-Bid Request for Information (RFI) No. 15.
DISCUSSION:
On July 7, 2026, the Board approved and awarded Agreement No. 17868, consisting of a construction contract to Avila Brothers Inc., dba Avila Construction Company, for the Bradley Library Replacement Project in the amount of $3,474,386. The Project includes construction of a new 2,500-square-foot library building, associated site improvements, utility extensions, a new septic system, fire protection infrastructure, a backup generator, Alternate Bid No. 1 for installation of a skid-mounted reverse osmosis system to provide drinking water for the County library and Alternate Bid No. 4 to remove petromat/water proofing membrane if found under existing asphalt.
During the bidding process, Addendum No. 3, Pre-Bid Request for Information No. 15, clarified that the contract time for construction would be measured in working days rather than calendar days. However, the executed construction contract inadvertently retained references to calendar days. Amendment No. 1 corrects this administrative inconsistency by revising the contract schedule provisions to reflect working days, consistent with the requirements issued during the bid process and relied upon by all bidders in preparing their proposals.
Proposed Amendment No. 1 does not modify the scope of work, increase the contract amount, or otherwise alter the terms and conditions of Agreement No. 17868. The total construction contract amount remains $3,474,386, and all other provisions of Agreement No. 17868 remain unchanged.
Approval of proposed Amendment No. 1 will ensure Agreement No. 17868 is consistent with the bid documents, maintain alignment with the construction schedule requirements communicated during procurement, and provide clarity for contract administration throughout the construction phase.
OTHER AGENCY INVOLVEMENT/COMMITTEE ACTIONS:
The Office of the County Counsel has reviewed and approved Amendment No. 1 as to form.
FINANCING:
Proposed Amendment No. 1 does not increase the contract amount. The estimated total cost of the Project is $7,312,073. Funding sources include $6,032,073 from Capital Projects Fund 1930 for construction and $1,280,000 from the Library Fund Balance for furniture, fixtures and equipment. Capital Project Fund 1930, Entity 320008, has sufficient appropriations in the FY 2026-27 Adopted Budget to support the Project.
BOARD OF SUPERVISORS STRATEGIC PLAN GOALS:
The recommended actions support the Board of Supervisors’ Well-Being, Quality of Life, Sustainable Infrastructure for the Present and Future, and Safe and Resilient Communities through the construction of a new Library Branch that will serve residents and students of Bradley as not just a Library, but also a resilient community center.
