a. Consider approval of the responses to the 2012 Monterey County Civil Grand Jury Interim Final Report Nos. 4, 5, and 6; and
b. Direct the County Administrative Officer to file the approved responses with the Presiding Judge of the Superior Court, County of Monterey, by March 11, 2013.

RECOMMENDATION:
 
It is recommended that the Board of Supervisors:
a. Consider approval of the responses to the 2012 Monterey County Civil Grand Jury Interim Final Report Nos. 4, 5 and 6; and
b. Direct the County Administrative Officer to file the approved responses with the Presiding Judge of the Superior Court, County of Monterey, by March 11, 2013.
 
SUMMARY:
 
The 2012 Monterey County Civil Grand Jury Interim Final Report Nos. 4, 5, and 6 were issued in December 2012.  By law, the Board of Supervisors and elected County officials are required to respond to specific findings and recommendations as directed therein.  Within 90 days of report issuance, on or before March 11, 2013, the Board's responses must be filed with the Presiding Judge of the Superior Court, County of Monterey.
 
The County Administrative Office coordinated preparation of the recommended response to the 2012 Monterey County Civil Grand Jury Final Report Nos. 4, 5, and 6 on behalf of the Board of Supervisors.  The Board of Supervisors approved responses should be deemed by the Monterey County Civil Grand Jury and the Presiding Judge of the Superior Court, County of Monterey, as the response of the Board of Supervisors to those issues raised by the Grand Jury regarding County operations, except as applicable to elected County officials.  
 
By law, elected County department heads, in this case for Interim Final Report No. 4, the Sheriff was required to file his response independently to the Presiding Judge by February 11, 2013.  The Board will receive an informational copy of the elected County official response when filed.
 
The recommended responses are intended to reflect staffs' understanding of Board policy.  Should the Board wish to modify the recommended responses, the Board is requested to direct the County Administrative Officer to do so and return with those changes at the February 26, 2013 Board meeting.
 
OTHER AGENCY INVOLVEMENT:
 
The County Administrative Office coordinated preparation of the recommended responses to the 2012 Monterey County Civil Grand Jury Final Report Nos. 4, 5, and 6 with the assistance, input and appropriate review by the following County departments:  County Administrative Office-Budget & Analysis Division, Emergency Communications, Health, and County Counsel.      
 
Members of the 2012 Monterey County Civil Grand Jury, the 2013 Presiding Judge and 2012 Past Presiding Judge were invited to attend the Board of Supervisors hearing on this matter.
 
FINANCING:
 
There are no fiscal impacts to the General Fund with this recommendation.
