RECOMMENDATION:
It is recommended that the Board of Supervisors consider and approve appointments to the Oversight Board for the Successor Agency to the Redevelopment Agency of the City of Del Rey Oaks
 
SUMMARY:
The County of Monterey is required to make certain appointments to the Oversight Boards created by the Dissolution Act (ABx1 26), which dissolved redevelopment agencies and governs the winding down of agency affairs.  The City of Del Rey Oaks has formed an Oversight Board and has requested the required appointments from the County of Monterey.
 
DISCUSSION:
The role of the Oversight Board is to review the Successor Agency's actions in enforcing existing obligations and winding down former agencies.  Oversight Boards can also direct the Successor Agency to determine if existing obligations should be renegotiated or terminated (even with damages) in order to reduce former agency liabilities and increase revenues to taxing entities.  In turn, the activities of both the Successor Agency and the Oversight Board are subject to review by the State Department of Finance.
 
All Oversight Boards include two members appointed by the county board of supervisors.    Under the Dissolution Act, Government Code § 1099, relating to incompatible offices, is waived and individuals may simultaneously hold membership on up to five Oversight Boards.  On March 20, 2012, the Board of Supervisors determined how to appoint "county members" pursuant to Health and Safety Code § 34179(a)(1) and "public members" pursuant to Health and Safety Code § 34179(a)(6) to Oversight Boards as requested by the individual jurisdictions.  Pursuant to Board action, the Chair designated to each Supervisor the responsibility for recommending appointments to both the "county member" and the "public member" for the specific Oversight Boards of the cities located within their respective districts.   The City of Del Rey Oaks is within the 4th Supervisorial District.
 
Applications for membership of the "public member" of the Oversight Boards pursuant to Health and Safety Code § 34179(a)(6) must be solicited in compliance with the Maddy Act (Government Code §§ 54970, et seq.).  These Oversight Boards are expected to exist at least until June 30, 2016, after which point the boards will be consolidated into a single Oversight Board, pursuant to the Dissolution Act.
 
On October 11, 2013 the city of Del Rey Oaks submitted a letter to the Board of Supervisors requesting that the County make the two appointments to their Oversight Board.  The "public member" vacancy was posted in accordance with the Maddy Act by the Clerk of the Board on October 16, 2013.  Supervisor Parker is recommending that she be appointed to serve as the County member. It is requested that the Public Member seat be appointed at a later date.
 
OTHER AGENCY INVOLVEMENT:
County Counsel's Office has reviewed the matter for compliance with the Dissolution Act.  The Clerk of the Board has also been consulted.
 
FINANCING:
The recommended action to appoint members to the Del Rey Oaks Oversight Board has no impact on the County General Fund.
