b. Accept the non-standard indemnification language as recommended by the Director of the Department of Social Services; and

c. Approve and authorize the Director of the Department of Social Services to sign up to three (3) amendments that do not significantly change the scope of work.

 

Report

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and authorize the Director of the Department of Social Services to sign a no-cost Memorandum of Understanding with the North Fork Rancheria of Mono Indians of California for Tribal Temporary Assistance for Needy Families retroactive to March 1, 2017.

b. Accept the non-standard indemnification language as recommended by the Director of the Department of Social Services; and

c. Approve and authorize the Director of the Department of Social Services to sign up to three (3) amendments that do not significantly change the scope of work.

 

SUMMARY/DISCUSSION:

The Monterey County Department of Social Services (MCDSS), through the Community Benefits and Employment Services Branches, currently serves eligible Monterey County residents with California Work Opportunity and Responsibilities to Kids (CalWORKs).

 

This Memorandum of Understanding (MOU) establishes a working relationship between the MCDSS and the North Fork Rancheria of Mono Indians of California (NFRMIC) to transfer the delivery of services provided to Native American families residing in Monterey County. Native American families of Monterey County who currently receive CalWORKs benefits and services are eligible to choose to voluntarily transition to receive Tribal TANF benefits instead of CalWORKS.

 

The provisions of this MOU will allow optimum communication between MCDSS and the NFRMIC to ensure that these eligible Native American families who choose the Tribal TANF services are transitioned in a timely and efficient manner from CalWORKs to Tribal TANF, and will prevent issuing duplicate aid. 

 

This MOU includes nonstandard mutual indemnification provisions and was delayed in being brought to the Board prior to the start date due to negotiations with the provider as to these indemnification provisions.

 

OTHER AGENCY INVOLVEMENT:

County Counsel has reviewed and approved this MOU as to form.  Risk Management has reviewed the MOU but cannot approve it due to nonstandard indemnity provisions. 

 

FINANCING:

This no-cost MOU has no impact on County General Fund contributions.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

This agreement correlates to the Administration Strategic Initiatives adopted by the Board of Supervisors by allowing the Department to collaborate with the NFRMIC to ensure efficient transition of services from CalWORKs to Tribal TANF for qualifying customers who choose to transition.
