RECOMMENDATION:
It is recommended that the Board of Supervisors:
  1. Accept the Conservation and Scenic Easement Deed for the Pini property;
  2. Authorize the Chair of the Board of Supervisors to execute the Conservation and Scenic Easement Deed; and
  3. Direct the Clerk of the Board to submit the Conservation and Scenic Easement Deed to the County Recorder for recordation.
 
SUMMARY/DISCUSSION:
On July 31, 2008, the Monterey County Minor Subdivision Committee approved the Pini Coastal Development Permit (County Planning File No. PLN040256; Resolution No. 08016) to allow a minor subdivision subject to 13 conditions of approval.  The subdivision was approved for two years, to expire on July 31, 2010.  However, Government Code Sections 66452.22 and 66452.23 extend the expiration date of the map to July 31, 2014.  Condition No. 4 of Resolution No. 08016 requires the Applicants to record a Conservation and Scenic Easement Deed (Coastal), and convey to the County of Monterey those portions of the subject property where the slope exceeds 25 percent.  The acceptance and recordation of the attached deed will satisfy Condition No. 4.
 
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel has approved the Conservation and Scenic Easement Deed as to form.  Staff submitted the draft deed to the California Coastal Commission (CCC) for review per Title 20, Section 20.64.280.A.6.g, and no comments have been received from the CCC.
 
FINANCING:
Funding for staff time associated with this project is included in the FY12-13 Adopted Budget for RMA - Planning.  Development fees have been collected to finance the processing and review required for the applicant to proceed.
