a. Approve and authorize the Chief Probation Officer to sign the Agreement between the Counties of Monterey and San Luis Obispo for the placement of youth at the San Luis Obispo Coastal Valley Academy for the term May 1, 2026 through April 30, 2027.

b. Authorize the Chief Probation Officer to sign future amendments, extensions, and any related documents pertaining to Agreement, subject to review and approval by the Office of County Counsel.

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                      Approve and authorize the Chief Probation Officer to sign the Agreement between the Counties of Monterey and San Luis Obispo for the placement of youth at the San Luis Obispo Coastal Valley Academy for the term May 1, 2026 through April 30, 2027.

b.                     Authorize the Chief Probation Officer to sign future amendments, extensions, and any related documents pertaining to Agreement, subject to review and approval by the Office of County Counsel.

 

SUMMARY:

Welfare and Institutions Code Section 888 authorizes the Juvenile Court Judge, under recommendation of the Chief Probation Officer, to order minors in their jurisdiction to be housed in another county in the respective camp facility, upon mutual agreement.  San Luis Obispo County has agreed to accept transfer of juvenile wards from Monterey County for placement at Coastal Valley Academy when necessary.  The proposed agreement identifies the counties’ mutual responsibility.

 

DISCUSSION:

In the past, the County of Monterey has entered into written agreements for the placement of a limited number of juvenile wards in respective camps and juvenile halls.  This option was established for cases where for reasons of the needs of the youth or protected custody, minors could not be housed in the camp or detention facility of the county of jurisdiction.  This agreement will expire on April 30, 2027 and has the option to renew.

 

Coastal Valley Academy (CVA) is a custody commitment camp program in Juvenile Hall for 14-17 year old male and female youth who are moderate to high risk and in need of residential treatment.  Youth are ordered to stay 6-12 months and receive intensive case management, treatment and educational services through collaboration with a local treatment provider, Family Care Network, and the County Office of Education.

 

This collaboration allows for proactive planning of unforeseen circumstances which might necessitate such an arrangement.  The proximity of San Luis Obispo County to Monterey also facilitates accessibility for staff and families, and a more cost-effective solution in the event of temporary out-of-county custody. 

 

OTHER AGENCY INVOLVEMENT:

The County Counsels for both Monterey and San Luis Obispo Counties have reviewed this agreement as to legal form.

 

FINANCING:

There will be no impact to the General Fund from approval of this action.  Monterey and San Luis Obispo counties have agreed to the per diem rate of $170 for each juvenile housed at the San Luis Obispo County Coastal Valley Academy facility, in the event such placement is needed. This rate applies to any day or portion of a day during which the juvenile is detained at the facility. The funds for this Agreement are included in Probation’s current year FY2025-26 Adopted Budget (PRO001, 8163) and FY2026-27 Requested Budget (PRO001, Unit 8163).  Further, the funds will be budgeted in subsequent FYs, through the term of the Agreement.
